HomeMy WebLinkAbout1590 RESOLUTION NO. 1590 WHEREAS, by quitclaim deed dated July 15, 1936, the United States of America remised, released and forever quitclaimed to the City of Little Rock, a municipal corporation of the State of Arkansas, certain lands lying in or near Little Rock, Pulaski County, State of Arkansas, and WHEREAS, said quitclaim deed contained the following provision: "(2) In time of national emergency, upon request of the Secretary of War, the City of Little Rock shall turn over complete control and operation of the entire Little Rock Municipal Airport, including the property thereon and that hereby conveyed, without rental or other charge, to the United States of America, f'or such use and for such length of time as the emergency shall require, in the discretion of the Secretary of War", and WHEREAS, said deed was made pursuant to an Act of Congress ap- proved May.15, 1936, Public No. 598, 74th Congress, 49 Stat. 1292, which provides: "In time of national emergency, upon request of the Secretary of War, the municipality shall turn over complete control and operation of the entire Little Rock Municipal Airport and the property thereon, without rental or other charge, to the United States of America, for such use and for such length of time as the emergency shall require, in the discretion of the Secretary of War", and WHEREAS, the Secretary of War has requested by letter of July 16, 1941, that the City of Little Rock turn over complete control and operation of that portion of the property conveyed by the aforementioned quitclaim deed identified as a warehouse and more particularly set forth within the red boundary lines, as shown on the attached map, which is made a part hereof; said map being the one attached to the letter of the Under Secretary of War dated July 16, 1941. NOW, THEREFORE, be it resolved by the Mayor and City Council of the City of Little Rock, a municipal corporation of the State of Arkansas, that pursuant to the aforementioned request, and pursuant to the provisions of the aforementioned deed and statute, the complete control, use and opera- tion of the above described warehouse, and such area or areas of the airport property as is needed for the parking of vehicles or aircraft (provided such use of said area or areas shall not impair or in any way interfere with the normal operations of the field as a municipal and/or commercial airport by the City) , is hereby transferred to the United States, without rental or other charge for use by the United States until the Secretary of War shall determine that military necessity for such use no longer exists. - ADOPTED: July 21 , 1041 .
