HomeMy WebLinkAbout1330RESOLUTION NO. 1330 A RESOLUTION GIVING AND GRANTING UNTO THE ;MAYOR OF THE CITY OF LITTLE ROCK FULL POWER AND AUTHORITY TO TAKE ALL NEC- ESSARY ACTION FOR REQUIRING IMPROVEMENTS IN THE WATER - 9ORKS SYSTEM OF THE CITY OF LITTLE ROCK, LOWERING THE RATES, AND ACQUIRING THE PRESENT �iVATER-11ORKS SYSTEM AND FOR THE FINANCING OF SUCH •ACQUISITION. WHEREAS, it is the consensus of opinion of the City Council that the Arkansaw itdater Company is now and has for many years been furnishing water to the citizens of Little Rock,which is unpotable, undesirable, and damaging to its citizens, vegeta- tion and machinery, at a grossly excessive rate, and. it is be- lieved that the Mayor should be given full power and authority to remedy this condition by negotiation or necessary action to remedy the source of supply, type of water, and rates charged, to bring to the citizens of Little Hock a p3atable and desirable water for domestic and industrial use at a fair and reasonable rate, and to acquire the present water plant and its property and a new source of supply within or without the County of Pulaski and to make the necessary financial arrangements therefor; and 0HEREAS, the City is no vv authorized by law to acquire said existing system and to construct and provide a new source of supply and the necessary pipe line for conveying same to the City of Little Rock for distribution and to pay therefor or finance the same solely from the revenues of said waterworks system and with- out pledging the credit or taxing power of the City of Little Rock; NOvi, THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK,ARK- ANSAS: Section 1. That R. E. Overman, mayor of Little Rock, be and he is hereby authorized and empowered to take such steps as he may deem necessary for the adjustment of water rates, the furnish- ing of a new water supply, or for the acquisition by purchase, con - demnation,or in any other lawful manner of such properties, of the Arkansaw eater Uompany in the City of Little Rock, Arkansas, and all rights, easements, and franchises relating thereto, and necess- 2- ary or convenient for the operation thereof, as may be deemed advisable and for the acquisition of a new source of water sup- ply of potable and desirable water, the necessary properties and rights to impound same and maintain a reservoir .therefor and for the construction of the necessary dams, pipe lines, and appurten- ances necessary or convenient for the proper operation thereof, and to make such agreements or take such steps as required by law found necessary to fix a proper and reasonable Drice and terms for the payment thereof. bection 2. The said Mayor is hereby fully authorized and empowered. to make all arrangements and enter into contracts for the employmenV of engines , �cprt;f'i d public accountants, attorneys and other persons necessary to properly instigate and determine all matters and things deemed necessary or advis- able for determining the value of said plant, the desirability of purchasing same, the proper rates to be charged to the citizens for the water so furnished or to be furnished, and to handle all legal matters necessary in fixing said rates, obtaining said new supply or the acquisition of the present system and its appurte- nances, and the financing of all said matters, it being understood., however, that all fees and expenses incurred in the acquisition or construction of said water plant and new source of supply shall be paid solely from the proceeds of bonds issued therefor and pay- able solely from the revenues of said water system. Section 3. That the said Mayor be and he is hereby au- thorized and empowered to enter into agreements for financing the acquisition of a new source of water supsply, of the present exist- ing system and of all appurtenances thereto and the construction of such betterments and improvements, including the necessary prop- erties, dams and pipe lines for the new source of supply, and for obtaining said funds from the U.
