An Ordinance Granting to Beal - Burrow Dry Goods Company the
Privilege of Extending the C. R. I. & P. Spur Trace: or Switch
Now Terminating at the East Side of the Llley in Block 2,
City of Little Rock,. Across said Alley, and
for other purpses.

Section 1. That in consideration of the payment of 9`25.00
per annum, payable annually in advence, at the office of the City
Collector of the City of Little Rock, by the Beal- Burrow Dry Goods'
Company, the said Beal - Burrow Dry Goods Company, its successors
and assigns, are hereby authorized to construct, maintain and oper-
ate, for a period of twenty -five :Dears from the date of the pass -
age of this ordinance, a line of railway, or spur, or switch,
across the alley in Block 2, City of Little ock, from the present
terminus of the Rock Island track as at present situated, end into
and u) on the west half of said block.
Section 2. The grantee hereunder shall maintain said spur
track or switch so that the top of the rails shall be on a level
with the grade of the alley as now or hereafter established, and
the City shall have the right to alter said grade at its -pleasure
without resaonsibility to said grantee, and said grantee shall
hold the City harmless from damages of any kind which may be oc-
casioned by said spur or switch or the use of same, and said spur
or switch shall be so conducted as not to interfere with any of
the usual traffic in and along said alley, and shall further main-
taro, between said rails, and for two feet outside each rail
thereof, a pavement of like character and material as may now or

hereafter be laid at that point, and shah in the construction_
and maintenance of such spur track or switch make provision for
the proper discharge of all surface water or make such drain as
may become necessary by reason of the construction or maintenance
of said spur track or switch.

Section 3. This ordinance shall be in force and take ef- 44
fect only upon its acceptance, in writing, by the grantee upon
the margin of the record of this ordinance when recorded, within
thirty days after its passage. all ordinances and parts of ordi-
nances in conflict herewith are hereby repea-Led.
