By transmittal of this letter, please be advised that I am exercising a Mayoral Veto of the above -
referenced Ordinance No. 20,716, Z -8833 Baker Long Form PCD.
In reviewing the documents submitted and the decision before the Board of Directors on April 16,
2013. I believe the PCD, for 5.1 acres, for what is in essence a C -4 Outdoor Storage use is
inappropriate and is not in keeping with the pastoral nature of the area.
The PCD use is in contravention of both the Land Use Plan providing for low- density residential
and inappropriate with the current R -2 zoning. I would also note that undeveloped commercially
zoned property exists nearby.

12 Section 1. That the zoning classification of the following described property be changed from R -2,
13 Single - Family, to PCD, Planned Commercial District:
14 Part of the SE '/, SE '/ of Section 9, T -2 -N, R -14 -W, Pulaski County, Arkansas, more
15 particularly described as follows: Beginning at the southeast comer of said SE '/ SE '/,
16 Section 9; thence NO2 °04'07 "E along the east line of said SE '/ SE %, 141.49 feet;
17 thence continue NO2 °08'39 "E along the east line of said SE '/4 SE '/4, 481.41 feet; thence
18 N88 048'21 "W 343.05 feet to a point of the east right -of -way line of Arkansas State
19 Highway #300 thence along the east right -of -way line the following courses
20 S00 031'21 "E 5.02 feet; thence S13 °54'48 "W 100.76 feet; thence S05 °21'07 "W 100.18

26 Section 2. That the approval of Baker Long -Form PCD (Z- 8833), located in the 7000 Block of
27 Highway 300, is subject to compliance with the following additional conditions:
28 • That the preliminary site development plan/plat be approved as submitted, including all
29 staff comments and conditions as outlined in the Planning Commission Agenda Staff
30 Report in paragraphs D, E, F and including any conditions indicated in the staff analysis
31 in paragraph H and subject to additional conditions imposed at the Planning Commiss' 1RCbr
32 Public Hearing as amended by the applicant.

I Section 3. That the preliminary site development plan/plat be approved as recommended by the
2 Little Rock Planning Commission.
3 Section 4. That the change in zoning classification contemplated for Baker Long -Form PCD (Z-
4 8833), located in the 7000 Block of Highway 300, is conditioned upon obtaining a final plan approval
5 within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances.
6 Section 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little
7 Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects
8 necessary to affect and designate the change provided for in Section 1 hereof.
9 Section 6. That this ordinance shall not take effect and be in full force until the final approval of the
10 plan.
11 Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
12 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
13 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
14 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
15 ordinance.
16 Section 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent
17 with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
