3 AN ORDINANCE TO GRANT A FRANCHISE TO THE BELLE POINTE
4 PROPERTY OWNERS ASSOCIATION FOR THE PLACEMENT OF
5 FOUR (4) SIGNS THAT NOTIFY THE PUBLIC THAT THE
6 NEIGHBORHOOD IS UNDER TWENTY -FOUR (24) -HOUR
7 SURVEILLANCE, AND THE INSTALLATION OF TWO (2) SECURITY
8 CAMERAS IN THE RIGHT -OF -WAY OF THE INTERSECTION OF
9 PLEASANT HEIGHTS DRIVE AND BELLE POINTE DRIVE; AND FOR
10 OTHER PURPOSES.

12 WHEREAS, the Belle Pointe Property Owners Association ( "BPPOA ") has applied for a franchise
13 that would allow the installation of four (4) small signs that notify the public that the neighborhood is
14 under twenty-four (24) -hour surveillance and two (2) security cameras, all to be placed in the public right -
15 of -way as reflected in Exhibits "A ", "B" and "C ", attached hereto and incorporated by this reference; and,
16 WHEREAS, the security cameras will be mounted on a single painted steel pole that is four (4)
17 inches in diameter in the locations shown on the exhibits; and
18 WHEREAS, the security cameras will be placed approximately twelve (12) feet above grade; and,
19 WHEREAS, BPPOA understands and agrees that the City of Little Rock assumes no responsibility
20 to maintain or replace any sign, pole or security camera placed in the public right -of -way; and,
21 WHEREAS, BBOA acknowledges that it has agreed to hold the City harmless from any and all
22 damages, liability and expenses, including attorney's fees, that arise out of any claim against the City by
23 any person, firm, corporation, partnership or company for which the City may become liable as a result of
24 any act, omission or negligence of the Applicant as it relates to the installation, ownership and operation
25 of the Franchised Items installed and operated by the Applicant in the public right of way
26 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
27 OF LITTLE ROCK, ARKANSAS:
28 Section 1. The Belle Pointe Property Owners Association is hereby granted a franchise to install
29 four (4) small signs that notify the public that the neighborhood is under twenty-four (24) hour
30 surveillance and two (2) security cameras, all to be placed in the public right -of -way at locations reflected
31 on Exhibits "A ", "B" and "C ". The franchise is subject to all the terms and conditions Fpxt! lit), the

Section 2. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph,
item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or
unconstitutional, such declaration or adjudication shall not affect the remaining provisions of this
ordinance, as if such invalid or unconstitutional provision was not originally a part of this ordinance.
Section 3. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this
ordinance are hereby repealed to the extent of such inconsistency.
