TO LEO PFEIFER THE RIGHT TO CONSTRUCT A LINE OF SEVIER IN AND THROUGH PORTIONS OF PFEIFER' S ADDITION TO THE CITY OF LITTLE ROCK, AIM FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK: Section 1. The privilege is hereby granted to Leo Pfeifer, his heirs and assigns, to construct and maintain, for the period of this frarichise, at his and their own expense, certain lines of sewer mains -in Pfeifer's Addition to Little Rock, Arkansas, more definitely described as follows: A line of six -inch sewer through and approximately the length of the alley in Block 20 of said addition; A line of six -inch sewer beginning along the above de- scribed line of sewer near Lot 5 in said block, running south along the east line of Lot 16 in said block across Fourth Avenue, and. thence south along the east line of Lot 5, Block 15, to the alley; A line of six -inch sewer through and approximately the length of the alley in Block 15 of said addition, and extending into Magnolia Street, thence south on IEiagnolia Street to the man- hole in the sewer line previously built just south of Second Avenue; A line of six -inch sewer in the alley of Block 14 emptying into the line in Mlagnolia Street, of sufficient length to serve Lots 1, 2, 3, 4 and 5 in said Block 14; A line of six -inch sewer in the alley of Block 14 of said addition running east from a point south of Lot 6 in said block to Harrison Street, thence south on Harrison Street to connect with the sewer heretofore built and running diagonally across said street just north of its intersection with Second. Avenue; A line of six -inch sewer in the alley of Block 9 of said addition of sufficient length to serve Lots 1, 2, 3, 4, 5 and 6, to connect into the sewer on 14agnolia Street; six -inch A line of /sewer in the alley of Block 9, to serve Lots 7, 8, 9, and 10, Block 9, and connecting with the sewer heretofore built running diagonally through Block 9; f i A line of six -inch sewer from a point in the alley, south of Lot 6, Block 19, of said addition, to a point south of Lot 1 of said Block 19, thence south inside the property lines of Lot 12 in Block 19, Lots 1 and 12 in Block 16, and Lot l in Block 13, connecting with the line heretofore built diagonally across Lot 1 in said Block 13• Said sewer mains shall be constructed by the said Leo Pfeifer under the direction and supervision, and according to plans and specifications approved by the City Engineer of the City of Little Rock, Arkansas; provided, such right -of -way therefor as may be neces- sary over private property shall be secured by the said Leo Pfeifer, his heirs and assigns, at his and their own expense. Section 2. Whereas, the above lines of sewer are to be con- nected with and empty into a line of sewers heretofore built, which are cared for by a septic tank, in consideration of the granting of this franchise, the said Leo Pfeifer, his heirs and assigns, agree to enlarge said septic tank, if necessary, and the said Leo Pfeifer, his heirs and assigns, and other property owners, shall at all times during the life of this franchise maintain said line of sewers and said septic tank in a sanitary condition, and in the event said tank and the line of sewers described herein are not kept in such condition, said tank and said line of sewers may be taken over by the City of Little Rock, maintained, cleaned, cleared and placed in a sanitary condition, at the expense of the said Leo Pfeifer, his heirs or as- signs, or anyone claiming or holding under him, to the extent V± the ratio of sewerage from the properties connected to this line of sewers bears to the entire discharge into said tank, and the amounts so ex- pended in the maintenance, cleaning or clearing of said line of sewers or said tank in said ratio shall be charged. to the said Leo 'Pfeifer and, at the option of the City, may be deducted from such settlements as may be made with the said Leo Pfeifer by the City Collector. Section 3. The said Leo Pfeifer shall construct said sewer and, if necessary, enlarge said septic tank, and shall pay all a the expenses thereof, and shall properly maintain both said sewer and said tank to said extent for the period of this franchise, and the said Leo Pfeifer, his heirs and assigns, are hereb�j granted for said period the exclusive control of said sewer lines hereby au- thorized to be constructed, and he and they are hereby authorized to permit or prevent connections therewith by any person, firm or corpo- ration except upon the terms and conditions herein specified. Section 4. Any person, firm or corporation being the owner or of *me-rs of any lot or lots of land adjacent or accessible to said sewer lines are hereby permitted to form a connection with said sewer lines upon the payment to the City Collector of the City of Little Rock, for the account of the said Leo Pfeifer, his heirs or assigns, of a sum not exceeding 40.00 for each and every connection, and the further payment to the City Collector of the City of Little Rock, for the account of the City of Little Rock, of a sum not exceeding °10.00 for each connection; provided, however, said gross charge of 650.00 contemplates a connection for one residence and the usual out- houses only, and if one connection is made to serve more than one residence and the necessary outhouses thereto, said gross charge of '50.00 shall be collected for each residence served by said. connection. . Section 5. Said line of sewers is constructed for the purpose of serving all of Blocks 9, 14, 15, 19 and 20 in said addition, and no charge shall be made for connections for any of said lots except the usual charge under the general ordinances of the City of Little Rock for the necessary connection permit. Section 6. Permits shall be issued to no person, firm or cor- poration, except to the owners of lots in the above described blocks, by either the City .Engineer or any other official or department of the City of Little Rock, unless the fees and charges above set out have been previously paid to the City Collector. y Section 7. Regular settlements shall be made by the City Collector with the said Leo Pfeifer, his heirs or assigns, every six months, and such amounts as have been collected for the account of the said Leo Pfeifer, less any commission due the City under its general ordinances for making such collections for his account, shall, at such settlement periods, be paid over to the said Leo Pfeifer, his heirs or assigns. Section 8. In no event, without an amendment to this ordi- nance properly passed by the City Council of the City of Little Rock, shall the connections made with said line of sewer or with any sewer mains or lines emptying into said lines or mains authorized to be con- structed under this franchise exceed ninety -two in number. Section 9. In all events, regardless of the number of connec- tions made or of the amounts paid to the said Leo Pfeifer, his heirs or assigns, or anyone claiming or holding under him, all of the right, title and interest of the said Leo Pfeifer, his heirs or assigns, or anyone claiming or holding under him or them, shall cease and terminate at the expiration of fifteen years from the date of the passage of this ordinance, and said sewer mains and lines and all the right, title and interest of any of said parties in or to said septic tank shall pass to the City of Little Rock, and all rights of the said Leo Pfeifer, his heirs or assigns, or anyone claiming or holding under him under this franchise shall cease. Section 10. All ordinances and parts of ordinances in con- flict herewith are hereby repealed, and this ordinance shall take ef- feet and be in force from and after its passage. Passed July 25, 1921.
