NO. 2916. ,a r An Ordinance Providing for the Filing of a Bond by Sidewalk, Curb, Gutter, Pavement, Sewer, and Certain Other Contractors, Providing the Procedure under said Bond for Repairing AZ Defective Work Performed by Such Contractors, Naming the Penalty for Violation Hereof, and for other purposes. 411 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE CK: Section 1. Before any person, firm or corporat o� N4shall hereafter be permitted to lay or repair any sidewalk, cub, gutter, or the like, or to lay or repair any pavement, or to build or lay any sewer, or the like, or to do or p erform any other public work on the streets, sidewalks, alleys or other pub- lic places in the City of Little Rock, said person, firm or cor- poration shall deposit in the office of the City Collector a cash bond in the sum of t200.00, conditioned for the faithful perform- ance of any of such work, and such sum so deposited shall be sub- ject to all the provisions of this ordinance. Section 2. Any person, firm or corporation above de- scribed shall well and truly perform the work set out above, for which a permit may be granted, to the satisfaction of the City Engineer and as required by contracts and ordinances in reference thereto, and shall pay for all labor done and material used in said work, and turn said work over to said city or person for whom done on or before the time specified for its completion, in which event the above described cash deposited with the City Col- lector shall remain intact; but in the event such work is not performed to the satisfaction of the City Engineer, or not as re- quired by contracts or ordinances in reference thereto, or in the event such person, firm or corporation shall not pay for all labor i done or material used in said work, or shall not turn said work over to said city or person for whom done on or before the time specified for its completion, the sum required to be deposited by this ordinance with the City Collector shall be subject to such legal claims as may arise by reason of such person, firm or cor- poration not performing said work to the satisfaction of the City Engineer, or in accordance with contracts or ordinances in refer- ence thereto, or as may arise for nonpayment for labor or materi- al, or damages for failure to complete or turn said work over to the city or person for whom done within the time specified, and such fund, or as much thereof as may be necessary, shall be ex- pended under the supervision of the City Engineer for repairing or replacing said work,or paying the accounts above referred to for labor or material, or liquidating such damages as may accrue on account of the failure to complete within the time limit, and to care for such other contingencies as may arise out of or inci- dental to the failure to perform said work in a proper and work- manlike manner. Section 3. No permit shall be issued to any person, firm or corporation to do any of such work until such cash bond shall be deposited. Section 4. Any person, firm or corporation who shall do any such work without having complied in every respect with the provisions of this ordinance shall be deemed guilty of a mis- demeanor and, upon conviction thereof, shall be fined in any sum not less than $5.00 nor more than $25.00. Section 5. All ordinances and parts of ordinances in conflict herewith are hereby repealed, and this ordinance shall take effect and be in force from and after its passage. Passed : .,iarch 6, 1922.
