An Ordinance Granting to the �Interprise Dumber Company the Right to
Construct and ; aintain a Line of Sewer from a Z oint in the
1_A -11ev Opposite Lot 4, 7lock 11, C. F; P. Johnson's Addition,
South Through Said Alley, Across 18th Street, to the I_anhole in the
Alley in Block 1, Chickasaw ,addition to the Cit�T o. Little
Rock, Arkansas, and for other purposes.
BE IT ORDnIIIFD BY TT CITY COUITCIL OF 11=, CITY OF LITTLE ROCT':
Section 1. The privilege is hereby granted to the Enter-
prise Lumber Company of Little Rock, Arkansas, its successors and
assigns, to construct and maintain for the period of this franchise,
at its aril their own expense, a line of sewer main beginning at`�a
point in the v.1ley opposite Lot 4, Block 11, C. and P. j ohnson' s
Addition to the City of Little Rock, Arkansas, thence south through
said alley, across 18th Street, and south through the alley of Block
1, Chickasaw A31,11ition, to a manhole located in sail alley and con-
nected with the Fourche Sew er. i2rovidel, that said sewer shall be
constructed. only according to such plans and specifications as may
be approved by the Superintendent of Public `"'orks.
Section �. In consideration of the F,nterprise Lumber Company
advancing the funds necessary -For the construction of said se---er, <n�
for the proper maintenance thereof, the said. Enterprise Lumber Coripany,
its successors and assigns, are hereby granted the exclusive control
of the sewer main hereby authlori7ed to be constructed, -for and during
the jjoriod provided by this ordinance, and they are hereby* �ntbflxized_
to permit or prevent any connection therewith by any person or persons,
corporation or corporations, except upon the terms and conditions
specified in this ordinance.
Section 3. The Enterprise Lumber Company, its successors and
assigns, shall 'permit all property oi7ners, ui:on their securing permit

from tie Department of public 'orks of the City of Little Rock, to con-
nect with said sewer at a cost not to exceed ",k,40.00 per connection, which
sum shall be paid, to the City Collector of the City of Little Nock, of
vhich sur. the City shall receive a commission of three per cent for mak-
ing such collection and the sum of `'10.CC per connection in addition
th- ereto; the remainder thereof shall be collected for the account of
the Enterprise Lizmher Company, its successors or assigns, settlements to
be made by the City Collector with the said Enterprise Lumber Company,
its successors or assigns, at the expiration of every six month period.
Section 4. The said Enterprise Lumber Company, its snc-
cessors and assigns, bind themselves to keep and maintain said sewer for
the period of this franchise in good and sanitary order and repair, and
in the event said sewer lines are not maintained in such condition, to
the satisfaction of the Health Department of the City, of Little 'Rock,
the City may at an-17- time take over said lines or make such repairs as
may be necessary, charging the cost thereof against any collections Trade
for the account of the yid enterprise Lumber Company, or its successors
or assigns, and, in the event such collections are less than the actual
cost of sz-A.9 repairs or Tna intenance , the sai. cI i nt er prise lumber Cor.,T)any,
its successors or assigns, shall pay balance due tr.erefor to the City of
Little Rock.
Section 5. In any event, at the expiration of six years
from the date of the passage of this ordinance, all the right, title and
interest of the sail Enterprise Lumber Company and its successors and as-
signs shall cease under this grant and said sever lines and mains and all
rights under this franchise shall pass to the Cit,T of rattle ??ock.
Section 6. This ordinance shall be in full force and ef-
fect onl;i upon the written acceptance by the said Enterprise Lnrsber Com-
pany upon the margin of the record of ordinances in the clerk's office,
which shall be within thirt`% days from the date, of its passage; otherwise
this ordinance shall be of no force or effect.
