which lie ;;i thin the cor-
porate limits of the City of Little Rock, on the 16th day
of April, 1912, executed its Bill of Assurances and Deed of
Dedicaticn of said land as an addition to the city to be
known and dedicated as the "Country Club Heights Addition ",
which said plat contained blocks numbered from one to eleven,
inclusive; and,

filed for record with the Clerk of the Circuit Court and
L'1- Cfficio Recorder of .needs of Pulaski County, but was never
f or:ner 1y accepted by the City of Little cock, as required by
law; and,
I;V=EAS, many of said lots have . peen sold to
various persons with reference to said plat; and certain
streets, as shown by said plat, were opened to the public
use, and have been used by the public since the date of the
filing of said plat and Bill of Assurances; and,

said original I)lat divided into nine lots numbered cunsecu-
Lively from one (1) to nine (9), inclusive, with an alley
running through said block from south to north; but said
alley has never been used by the public, but has lain open
as a public common; and,

i'r=,EAS, Deaderick H. Cantrell and Catherine E.
Cantrell, his wife, have become the ovmers in fee of all of
said lots in said block eight, and in conjunction with the
said Southern Trust Co.,ipany on the 10th day of October, 1923,
filed with the Clerk of the Circuit Court and Lx- Officio
Recorder of Deeds of Pulaski County, their replat of said
block eight, wherein they vacated said alley and divided
said block into ten lots, by which lots one (1), two (2),
three (3) and four (4) are designated as fifty feet front
on Third Avenue by 140 feet deep; and lot five (5) is
designated as sixty feet front on Third Avenue by 140 feet
deep; axed lot six (6) is designated as sixty feet fronton
Newton's Addition to the City of Little Rock, lying on the
west of said block) by 120 feet deep; and lots seven (7),
eight (8), nine (9) and ten (10) are designated as fifty
feet front on said Newtonf s Addition to said city by 120 feet
deep; and have further shown by said replat the location of
Third Avenue on the east of said block and Diwnond Street
on the :South of said block; and by said plat have dedicated
to the city one -half of each of said streets upon which said
block abuts, and desire the city to accept said replat and
dedication;
NOW, T=- EFORE, said replat of said 'clock eight
of the Country Club Heights Addition to the City of Little
Hock, made by said Southern Trust Company and Deaderick H.
Cantrell and Catherine E. Cantrell, his wife, on October
10, 1923, be, and the same, is hereby accey -ted by the City
of Little Hock, and the alley through said block from north
to south, as shown on the oriC.,inal plat of said addition,
filed with said Clerk of the Circuit Court on the 16th day
of April, 1912, is hereby vacated and left out of said block,
the same not being requisite for corporate purposes.
