erection 1. For the purpose of constructing,
maintaining and o.,,eratirig an electric standard -guage street
rail�uwj system Sri th single or double tracks, sidetracks, switches
and turnouts, including the necessarir overheU.d wires, conduits
and trolley- poles f or the suppl -r of p ever for its ovin use, the
City Council of the City of Little Rock does hereby grant unto
the Intercity Terminal Railvray Comlany, and unto its successors
and assigns, upon the terms and conditions hereinafter set f or th,
for a period of ears from the date of the passai,e of this

overhead trolley, on Lain Street and on the Twain ;:street bridge
constructed by the :roadway -Hain Street Fridge District across
the :ixkansas river, between the north line of Harkham Street
and the boundary lire between the said cities of Little Rock: and
ITorth Little Rock, subject to any ey:isting rights of the Arkansas
Central Power Company on I.1ain Street.
Said Intercity Terrinal Railway Company may make
connection with the tracks of said .Arkansas Central Povyer Co»'any,
its successors and assigns, upon such terms and conditions as
may be agreed upon between said companies; and the right is here-
by granted to the Intercity Terr_tii.nal Railway Company to operate
its cars over the tracks of the Arkansas Central Doti ^rer Company
between Main and Liarkhan Streets and the car warn and shops of

said Arkansas Central lower Company now located at North and
Chester Streets, for the sole and only purpcse of transporting
its cars to be housed and repaired; but not for the purpose of
carrying passengers between the points aforesaid, provided,
that said Intercity Terminal Railway Company shall first obtain
the consent of said Arkansas Central lower Company for the oper-
ation of said curs over its tracks as aforesaid.
vection 2. As part consideration for this grant,
said Intercity Terminal Railway Company hereby agrees to permit
any bona fide interurban railway company, having a single or
double track line not less than seven miles in length, which has
obtained the consent qf the City r3ouncil of t, e City of Little
o.- ,& Oc-.
Rock, to use its tracks ^under such terms and conditions as may
be agreed upon between such interurban company and said Inter-
city Terminal Railway Company. In the event said cor_ipanies are
unable to agree upon terms and conditions, then the same shall
be arbitrated, each company to select one arbitrator and the tao
so chosen to select a thix•d, and the decision of a majority to
be binding upon both parties. In the event the two arbitrators
are unable to select a third arbitrator within thirty days from
the date of their appointrient, then the Judge of the District
Court of the United States at Little Rock, shall select the
third arbitrator.
Section 3. Said Intercity- Terminal Railway Con-
pany shall build a single or double track. street rail,rray line
of the overheat: single - trolley type, with all necessary curves
and switches on said bridge and the anpro ach thereto, and that

5.
Said company shall confine itself

exclusively to the carriaLe of pasjengers, except that it may

cam freight for its own use.
Section 6. Said oirx in the construction and
maintenance of its overhead lines in Main Street, shall use .petal
boles, and the city shall have the right to use such poles for
its street electric light wires, and for the wires of its _.-olyce
or fire alarm system; provided, that said poles shall be erected
of sufficient length so that tiZe city may string its wires at
least tilree feet above the company's vrires; and said city shall
at all tines maintain its wires in a good and safe condition, and
said company shall conform to all ordinances of the city as to
the direction and ainting of its .said voles.
Section 7. Said Intercity Terminal railway Com-
piny shall arrange with said Arkansas Central Po^:rer Company for
the transfer of passengers from either line to the other upon
the payment of a transfer- charge of t^fo cents f or each passenger
so transferred; Ixovided, that no transfer charge shall be k1ade
for any child five years of age, or under, when attended by a
per,�,on who pays full fare.
Section 3. That Ordinance No. 2037, passed Tan-
uary 5, 1914, by this Co-mcil granting to E. 'W. Jackson and
C. C. Kavanaugh, as t:: ustees for said Intercity Terminal Rail -
way Company, a franchise across said 1L-idge, be and the same is
hereby repealed.
:section 9. This ordinance shall become inopera-
tive and void unless s,,dd Intercity Terminal Railway Company
shall indicate, within ten days after its passage, its accept-
ance t1aereof by filing with the City Clerk a state:aent in vxit-
ing signed by the President or Secretary of said Intercity
Terminal Railway Co pany, being duly auth�ioized so to do, and
thereafter endorsing on the marlin of the record book in which
this ordinance is recorded its acce�-Aance thereof; and unless

contract which it may enter into with the Broadway -Main :street
Bridge District, and thereupon the said City Clerk shall record
said franchise or contract for the purpose. of evidencing com-
pliance by said company with the conditions hereinabove set
forth, and maintaining a permanent record thereof; and ilLen so
recorded said Clerk shall return said franchise or contract to
said company.

ordinances in conflict here.rith are hereby repealed, and this
ordinance being for the Luaiediate protection of the public peace,
health and safety, and for the support and maintenance of the
municipal government, and in the exercise of its police powers,
an emergency is hereby decla:r: ed, and this ordinance shall taLe
effect and be in force as a binding contract between the City of
Little Rock and the Intercity Terminal Railway Company, its suc-
cessors and assigns, from and after its passage, and its ac-
ceptance by said Intercity Terminal i ail -Vay Company.

Honorable Body Monday, March 17, 1924, repealing Franchise
Ordinance No. 2037 of this company, and granting; it a
right of Fray over that part of the Main Street bridge and
the approach thereto within the city limits of the City
of Little Dock.
