ORDINANCE # 3 4
AN ORDINANCE RATIFYING AND CONFIRMING THE ACTIONS OF THE
BOARD OF PUBLIC AFFAIRS, THE MAYOR AND CITY CLERK IN
PURCHASING CERTAIN TRACTS OF LAND AS PORTIONS OF THE NEW
PARK SITE, ISSUING THE CITYtS WARRANTS IN PAYMENT THERE-
FOR, CONFIRMING THE FUNDING AND RE- ISSUANCE OF SAID
WARRANTS AND FOR OTHER PURPOSES.
WHEREAS, under ordinance #-3359, the sum of three hundred thou-
sand dollars (.!J;300,000.00), or as much thereof as would be neces-
sary, was appropriated for the purpose of purchasing and equipping
a park site and a joint committee was appointed to select said
site and,
WHEREAS, under the authority of said ordinance, the joint
committee named therein, did report back to this council that they
had selected as a part of such park site, certain lands in Section
6, Township 1 North, Range 12 West, Pulaski County, Arkansas, and
said selection was approved by this Council, and,
WHEREAS, acting undplr the authority of ordinances #3452, 34530

3502, 3528, 3538, 3550, ^3511 35 b, 3588, 3597, 3581 3611 and 36,
warrants in full payment for said lands and certain necessary

labor and equipment used upon said park site, were issued under
the following numbers on the dates shown and for the following
amounts, to wit:-

AND W-HEREAS such warrants so issued were subsequently pre-
ented to the city and their re- issuance requested by the holders
ereof. , and,
WHEREAS, subsequent to such presentation, this council did,
by ordinances numbered 3627, 3625, 3604, 3554 and 3504 fund and
re -issue said warrants by the issuance and delivery of Series "All
Ilwarrants, numbered 861 to 898 inclusive.
WHEREAS this council has re- examined and re- investigated all
the facts relative and incidental to all of the above proceedings
and has found and does hereby find, adjudge and declare that the
action of the Board of Public Affairs, the Mayor and the City
Clerk, were in all respects authorized and performed under the
!direction of this council and that said Series "A" warrants as de-
scribed above were duly and properly issued and that the indebted-
ness represented thereby is a valid and binding obligation of the
city of Little Rock:
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF LITTLE ROCK, ARKANSAS AS FOLLOWS:
Section I - The actions of the Board of Public Affairs and of
the Mayor and the City Clerk in connection with and incidental to
the purchase of the property and the expenditures for material and
labor, for all of which the original warrants described in the
preamble to this ordinance were issued, and their actions in is-
suing said original warrants are :Hereby ratified, confirmed and
validated in each and every respect and the previous action of this
council in funding the original warrants so issued under the or-
dinances above described, under which Series "A" warrants numbered
B61 to 898 inclusive were issued is hereby confirmed, and said
Series "A" warrants numbered 861 to 898 inclusive are hereby de-
clared valid and binding obligations of the city of Little Rock,
krkansas.
Section II - This ordinance has the statutory effect of a
judgment determining the validity of Series "A" warrants, numbered
inclusive
361 to 898/for $200687.50 and the indebtedness represented there-
Dy and the holder or holders of said warrants may enter judgment

thereon in any court having jurisdiction of the parties upon pre-
senting to such court such warrants and a duly certified copy of
this ordinance; provided, however, that such warrants shall have
been first presented for payment at or after maturity, wh?ch fact
may be evidenced by statement thereon_, signed by the City Treasur-
ere
Section III - This ordinance is hereby determined to be an
ordinance for the support and maintenance of the municipal govern-
went of the City of Little hock, Arkansas and shall be in full
force and effect from and after its passage.
