AN ORDINANCE GRANTING RIGHT-OF-WAY TO JOE JUNG TO CONSTRUCT AND11AINTAIN A SWITCH

PURPOSES.
B ] IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE MOCK:
SECTION 1. That for and in consideration of the payment by Joe Jung,
his successors and assigns, of the sum of .,;2b.00 per year, payable in advance, a
tight -of -way be and the same is hereby given and granted to Joe Jung, his successors
and assigns, to construct, maintain and operate, for a period of Awyears from
the date of the passage of this ordinance, a single track connecting with the
Rock Island swtich or track in the rear of Swift & Comnany's plant, and extending
directly west across Ferry Street and on to the south 13 feet of Lot 4, Block
6, Pope's Addition to the City of Little Rock to a point approxi- lately 70 feet
12 inches from the east boundary of said lot.
SECTION 2. Tiis grant is conditioned that the said grantee, his successors
and assigns, sha-'1 so construct and maintain said track that the construction or
operation thereof shad in no manner affect or interfer with traffic along said
street, and that said track shall be laid to the grade of such street as such grade
is now or may hereafter be established by the proper city authority, it eing
expressly understood that the city reserves the right to chamge such grade at its
pleasure, v.,ithout in any ma.,_ner being rendered liable therefor to the grantee herein,
SECTION 3. This grant is further conditioned_ that said grantee, his
successors and assi: -ms, shall build and maintain between the rails of said tracks
and five feet on each side thereof, a pavement of like character, and material as is
now or may be laid along said street, and shall in the construction and maintenance
of all tracks or pavement under the terms of this ordinance make provision for the
proper discharge of all surface water and such drains as may become necessary by
reason of the construction of said track.
S__CTION 4. The City Council reserves the right to control and regulate the
speed of all engines, trains or other rolling stock on such track, and als reserves
the right to control and regulate the ti:,e within which said switching may be a.one,
and no car or other rolling stock shall be permitted to stand on the street orct)Ify
that is crossed by said tracks, but the street crossing shall at all time-,.be kept
free from cars or rolling stock except while switching is being performed.
SECTIOII b. It is further agreed, by the acceptance of this grant, that
the grantee, his successors and assigns, shall hold the city harmless from any
damage of any kind occasioned or arising; out of either the construction or the
use of, the operation of said track.
S <CTION 6. This ordinance shall be in force and take effect only u -on
its acceptance in writ-ing by the grantee herein u_)on the margin of the record of
this ordinance when recorded, within six months after its passage.
