AN ORDINANCE GRANTING TO TIE ARk:AtTSrGl BROOM WORTS THE "IG1T1_`T TO CONSTRUCT AND MAINTAIN A SV,,TITCH ACROSS T11E EIGHT= T FOTT ALLEY BET -WFIT BLOCT_ ONE, OIL MILL'S ADDITION A-ND ?HE MISSOURI D "_CIFIC RAILROAD CO117: VTY•S RIGHT -OF -WAY NEAR FAST SL'V XTH STREET, AND FOR OTIMP PURPOSES. BE IT ORDAINED BY 'TME CITY COUNCIL OF THE C' TY OF LITTLE ROCii: SECTION 1. That in consideration of the payment b -a the Vlrkansaw Broom works, its successors and assiCms, of the sum of One Dollar (;.1.00) pr r annum, which shall be due and payable in advance for each year during the term of this grant. The said 2rkansaw Broom 4;orks, its successors and assigns, are hereby granted pernission to construct and overate, for a period. of fifteen years from the date of this ordinance, a spur track, switch or siding across the eighteen foot alley between Block One, Oil Mills' Addition and the Missouri Pacific Railroad Company's Right -Of -lay near East Seventh Street, beginning on said right -of -way at Seventh Street and extending across the above described alley and across Lots Trine, Ten, ;leven and `iwelve, flock One, Oil Mill Addition to the City of Little Pock. This grant is conditioned that the said grantee, the - rkar�saw Broom Works, its successors and assigns, shall so construct and maintain said spur tract: that ti;e construction or operation thereof' shall in no manner affect or interfer v ;ith the regular traffic alon -- such alley, and that said srur tract: shall be laid. to the grade of such alley as is now or may hereafter be established by the proper city alzrhority, it being expressly understood arid agreed that the city herewith reserves the rir-ht to ch=- F-,e such grade 4it its pleasure v;ithout in any manner being rendered liable therefor to the grantee herein. Said grant is fart-,-i-ar conditioned that in the event the alley where said spar track is laid should be paved, the said grantee, its successors or assigns, shall build and maintain, between the rails of such spur track and two feet outside the rail- thereof, a pavement of like character and material asmay be laid along said alley, and shall, in the construction and maintenance of such spur track or paving, under the terms of this ordinance, make provision for the proper discharge of all surface water or make such drain as may become necessc,ry by reason_ of the construction of said snnr track. It bein?_ further agreed that in accepting the grant herein made the said grantee, its successors and assigns, shall hold the city ha_•mless from any damage of any kind occasioned or arising out of either the construction or the use or the operation of said spur track. SECTION 2. This ordinance shall be in force and to :�:e effect only upon its acceptance in writing on the margin of the record of this ordinance when recorded, within 60 days after its passage.
