AN ORDINANCE MENDING ORDINANCE N0, 4559 AND FOR OTHER PURPOSES.
Be It Ordained by the City Council of the City of Little
Rock, Arkansas:
Section 1. That Section 4 of Ordinance No. 4559 be and the
same is hereby amended in its entirety to read as follows: "Sec-
tion 4: That for making the inspections herein provided for, the
City Inspector shall charge and collect an inspection fee in
accordance with the following scale of rates:

BEGIN AT SECTION 31 OF ORDINANCE NO.4559
Section 3. It shall be the duty of the Inspector of
Weights and Measures at least once each Calendar year and as herein
provided to examine and test the accuracy of all instruments used,
or to be used, within the limits of the City of Little Rock in
weighing and measuring any substance, article, energy, or pressure
intended to be purchased, or sold, or any article to be shipped
from or received into the city of Little Rock, and all instruments
used, or to be used, within the city in weighing, or measuring any
person, or animal for hire, or reward, or which may be used in
such manner that the accuracy of such weight, or measurements, may
pecuniarily interest any person other than the owner before such
instruments are used, to stamp with a suitable seal each weight, measure,
scale or thing so used which he may find to conform, or which shall
be made to conform to the standard,prescribed by the laws of the
United States, the State of Arkansas and the National Bureau of
Standards, VPashington, D. C., which are now and may hereafter be in
force and to deliver to the owner thereof a certificate of their
accuracy.
Section 4, phenever the Inspector shall find as a result of
such inspection that any instrument used for weighing or measuring
articles or commodities sold in the city of Little Rock is not accurate
or does not conform to all laws of *%" city, State, U. ti., and the

Zshall promptly mark such instrument con-
demned, whereupon the owner shall have three (3) days within which
to correct or adjust said instrument, but no such instrument shall
be used for weighing or measuring commodities for sale again until
same has been approved. If upon notification the inspector is
advised that such instrument has been corrected he shall ir_imediately
reinspect such instrument and if found correct, approve and properly
seal the same. It shall be unlawful for any person to remove or break
any seal placed upon any instrument by the inspector. If at the end of
the three (3) days said instrument has not been corrected it shall be
the duty of the inspector to seize and destroy, in the name of the city
all false weights, measures and scales which he may find, and which the
owner shall fail to have immediately made conformable to the said laws.
The inspector herein provided for shall have full power and authority
to enter upon the premises at any time he desires for the purpose'of

dF inspecting, seizing or condemning any instrument, and said inspector
is hereby authorized and empowered to arrest forthwith any person who
shall hinder or interfere with him while making the inspections provided
by the ordinance.
Section 5. The Inspector of Weights and Measures shall charge
and collect for examining, testing, sealing and certifying as herein

or person in possession- or. control of any scale, weight or measure, employ;
labor or material in making such scale, weight or measure accurate, he

shall charge and receive from the owner or person, for the use of the
city';
a just and reasonable compensation for such labor and material.
Section 6. All persons, firms or corporations using instruments
for weighing and measuring shall furnish the Inspector any help that is
needed to make such inspections at the Inspectors request.
Section 7. The Inspector shall examine and test all such
instruments used for weighing or measuring at the stores,and used, and to
be used, and all persons using or intending to use such instruments
for weighing or measuring who have no regularly established place of
business within the City of Little Rock, shall take such instrument

to the office of the Inspector of Weights and Measures. Such person
taking such instrument to the office of the Inspector of 'Neights and
Measures shall so far as possible take the same to his office during t'..e
hours of 8 and 9 A. M., any week day of the year.
Section 8. It shall be the duty of said Inspector to make
an additional examination and test of any instrument used or to be used
in weighing and measuring whenever in his opinion such inspection may
be necessaryt and it shall also be his duty to perform such service
upon request, and at the expense of any parson owning or using any
instrument of weight or measure as often as thereto requested, by such
owner or user, or by any other person provided such other person shall
first pay the fees herein provided for such inspection.
Section 9. The Inspector of Weights and Pleasures, for .a
second or subsequent inspection and where weights, measures or other

things are found incorrect as are hereinabove described charge and
receive the same fees as for the first inspection.
Section 10. All persons using weights, measures, scales or other
things of the kind hereinabovb mentioned shall cause the same to be
examined, tested and sealed as hereinberore required, and no such
weights, measures, scales, or other things so., zsed shall,be c emed ins

spected, tested, or sealed until the owner ✓thereof sha ?�have paid for and
obtained a proper certificate or certificates from the Inspector of
Weights and Measures.
Section 11. Any person who shall fail or refuse to have any
instrument of weights and measures in his possession, or use, examined,
tested, corrected, or sealed and ciLlled upon for that purpose by the
Inspector, or shall willfully remove, destroy or any way or manner erase
any stamp or seal of inspection from any scale, weights and measures or
shall in any way or manner obstruct, hinder, or molest the Inspector of
Weights and Measures in the performance of his duties, shall be guilty
of a misdemeanor.
Section 12. It shall be unlawful for any person to have in
their possession any scale or other mechanical devices for the weighing
or measuring of commodities to be sold by them which has not been inspected
and bears the approval of the Inspector thereon.
Section 13. The business of repairing scales or mechanical
measuring devices is hereby declared to be a privilege and each person

engaged therein shall pay the sum of Fifteen ($15.00) Dollars per year
to the City Collector.
Section 14. Whenever any person, firm or corporation shall sell
or deliver any scales or other mechanical measuring device to any
person doing business in Little Rock he shall within forty -eight
hours report such sale to tae City Inspector.
Section 15. No Inspector shall sell, or offer to sell or repair,
or be interested directly or indirectly in the sale or repairing within
the City of Little Rock of any instrument used for weighing and measuring.
Section 16, No Inspector shall use any false instrument or
make any false test in making his examination and testing of instruments
used or to be used for weighing or measuring.
Section 17, The Inspector of Weights and Measures shall make
a monthly and yearly report to the;:ayor and City Council of all
instruments inspected and fees collected.'"

Section 19. Itinerant dairymen, peddlers, junk or rag dealers,
hawkers, and ice dealers using scales, weight, measures, or other things
to weigh or measure by shall take the same to the office of the Ins r

itinerant dairyman, peddler, hawker or ice dealer who shall fail to
comply with this section shall be deemed guilty of a misdemeanor.
Section 20. It shall be unlawful for any person to sell,0tg ka
or expose
offer for sale in the City of Little Rock any article of food or merchandise,
which is usually sold by weight or measure, in baskets, crates, bags, boxes,
packages, mould, print, or containers, unless there be stamped, labeled or
printed upon said basset, crate, bag, box, package, mould, -rint or contai er
the correct measure or weight of the quantity contained therein, and if such
commodity is of a kind that is usually sold by weight, the weights shown
shall be exclusive of the weight of the container. Such articles of

This section shall not apply, however, if the vender shall mark in plain
type or letters or tag on such baskets, crate, bag, box, package, mould,
print or container, the words, "This package is not sold by weight or
measure, but in bulk."
Section 21. "Scales" There shall be only one reading line on
any 2kzrK computing scale. All reading lines must be placed so as
to set at zero when scale is balanced. All scales must be at the zero
point before and after weighing and shall conform to the Tolerances
adopted by the National Bureau of Standards. :ill counter scales and
hanging scales must at all times be so installed that the reading line
is horigogtal wit � the eyes, of the average person, 5u 7 in. in height.
All counter and computing scales shall be set upon a solid foundation.
Suspension scales shall be hung from a strong permanent sunnort. The
reading of all scales shall be within three feet from the natural
position of the customer. Suspension or counter scales with dials, shall
not
have two dials and be glass covered. Scales mus.1/be located where the
air from a ceiling,or bracket,electric fan or any other thing shall
interfere with its veighingt and shall be condemned until such fan or

Section 22. "Milk Bottles$ Bottles used for the sale of milk or
cream shall be made only in sizes heretofore specified under the heading
clearly
"Liquid capacity measures FI Each bottle shall have its capacity,/blown
or otherwise clearly and permanently marked in or on the sidex of the
bottle and in or on the side or bottom the name, initials, or trade -mark
of the manufacturerg thereof. Glass bottles with an inside diameter of
not over 2 inches immediately below the cap seat or stopple shall hold
the correct capacity when filled to within one - fourth irch of this cap seat
or stopple; bottles with an inside diameter of over this amount immediately
below the cap seat or stopple shall hold the correct capacity when filled
to within one - eighth inch of this cap seat or stopple: Provided, however
that a larger distance shall be allowed below the cap seat or stopple when
the bottles are provided with a clearly defined line blown or otherwise
clearly and permanently marked in or on the bottle, and extending at least
halfway around it, which indicates the correct capacity, and directly over,

below, or beside this line, with the words "Fill to line" or a similar
and suitable inscription clearly and permanently marked in or on the bottle.
Any person, firm or corporation selling or offering for sale milk or cream
in any such bottle or jar, or having in his or its possession any such bottle
or jar, to be used for the purpose of containing milk or cream to be sold
or offered for sale in the city,- of Little Rock,or which shall be found
to be of less capacity than that blown on bottle shall be guilty of s
misdemeanor, and all bottles of milk which do not come up to the requirements
of this section shall be seized by the inspector of weights and measures and
given to the Charitable Institutions of the city of Little Rock.
Section 23. "Lubricating Oil Bottles." Bottles used for the
sale of lubricating oil shall be made of clear, uncolored glass and only in
sizes heretofore specified under the heading "Liquid capacity measures."
They shall be made to contain their indicated capacities of a temperature
of 200 C. (680 F.), and they shall not be subdivided, Each bottle shall
have its capacity clearly blown or otherwise clearly and permanently marked
in or on the side of the bottle, and in or on the side or bottom the name,
initials, or trade -mark of the manufacturer thereof. Bottles shall be
provided with a clearly defined graduation line blown or otherwise clearly
and permanently marked in or on the bottle, and extending at least halfway
around it, which indicates the correct capacity, and with the words,
"Fill to line" or a similar and suitable inscription clearly and permanently
marked in or on the bottle and clearly referable to this graduation line.
This line shall. in no case be more t an 0.10 inches in width and the bottom
edge of the line shall define the top of the meniscus of the water which is
used in the test of the bottle. This graduatJon line shall be placed so that
it is at least one- fourth inch belov, t'^e bottom of any metal top when this is
scre;.ed firmly into place. The capacity of that portion of the bottle
above the bottom of the graduation line shall be at least 3 cubic inches.
'. &hen a bottle is equipped with aSpout, this shall be so constructed that
free and unobstructed drainage is provided. This specification shall be
construed to require that there be an effective air vent in the spout and
no shoulder or other obstruction tending to result in a trapping of the
liquid being delivered. The spout shall not be over 6 inches in length measured
from the point of contact with the top of the bottle to the tip of the spout.

Section 24. "Liquid Measuring Devices for dispengsing Gasoline."
All liquid- measuring devices shall be so designed and constructed that
they can readily be operated to deliver each quantity for which a graduation,
stop, overflow pipe, or other indicating means is provided, within the
tolerance on such amount hereinafter provided. All liquid measuring
devices shall not be in a normal operating position until they are level.
All visable liquid measuring devices Of the vis;ble type shall be equipped
with permanent markets indicating each gallon etched on X gl: ss bowl.
Etching shall be at least 2 inches long on each side of amount indicates.
There shall be not less than two set of markers on each bowl. All visable
pump bowls must be at all times kept clean so that all pamkers can be
seen plainly by the purchaser. All vis&*U,e gasoline pumps shall have a
cut -off nozzle at the end of hose, and hose shall be full of gasoline
at all times. It will be unlawful for any person, firm or corporation to make
any new instalktions or exchanges of gasoline pumps without notifying the
Inspector of '«eights and Measures. And shall also notify said inspector
when replacing any broken bowl. Any person, firm or corporation owning,
operating or using any automatic or mechanical pump or liquid- measuring device
for the purpose of measuring any liquid commodity to be sodl or offered for
sale within the city of Little Rock, shall provide proper tested standard
measures, and shall each day before making the first sale in the morning,
and always before commencing to sell a new supply of liquid, test the accuracy
of the device so in use.
Section 25. "Ice." Every person, firm or corporation selling
ice of` offering ice for sale shall, at the time of delivery of any ice sold,
weigh the quantity of ice delivered, and for that purpose shall be provided
with a steel -yeard balance or other apparatus for weighing such ice, which
shall have been duly adjusted and sealed by the inspector of weights and
measures in accordance with the provisions of this ordinance; and all ice sold
within the city shall be sold by avoirdupois weight unless it is otherwise
