HomeMy WebLinkAbout5130ORDINANCE NO. 5130 AN ORDINANCE GRANTING TO THE N0: KNOWN AS THE FARMERS CURB MARKET,INC.,THE TO OPERATE THE LITTLE ROCK MUNICIPAL CURB AT THE NORTHWEST CORNER OF FOURTEENTH AND ROCK, FOR A PERIOF OF TV.TNTY ( 20) YEARS. v— PROFIT SHARING CORPORATION RIGHT, FRANCHISE AND PRIVILEGE MARKET UPON THE PROPERTY LOCATED CROSS STREETS, CITYOF LITTLE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK: Section 1. That a franchise to operate the Little Rock Municipal Curb Market, to be located at the Northwest corner of 14th & Cross Streets in the City of Little Rock, is hereby granted, for a period of twenty (20) years from date hereof, to the Farmers Curb Market, Inc. Section 2. In consideration of the operation of the Little Rock Municipal Curb Market by the said Farmers Curb Market Inc., as a mutual undertaking for the benefit of both the farmers selling products grown by them at said market and the citizens of Little Rock purchasing at said market, this franchise is granted for the period aforesaid without the imposition by the City of Little Rock, of any annual fees or charges to be paid by said Farmers Curb Market, Inc. Section 3. Should the Farmers Curb Market, Inc., cease to operate the Little Rock Municipal Curb Market or cease to be a non — profit sharing corporation operated solely for the mutual benefit of the farmers selling at said market and the citizens of Little Rock purchasing at said market, this franchise shall be deemed to be terminated and the City Council reserves the right to assign such franchise to such other persons as it may deem proper. Section 4. Provided that nothing in this ordinance shall be construed to permit or authorize the operation of any business or the selling or offering for sale of other than agricultural products grown by the seller, at the said Little Rock Municipal Curb Market, without securing permit from the City Council and the payment to the City of Little Rock of the usual license fees and /or taxes, now in effect or which may hereafter be lawfully provided for other similia.r businesses in the City of Little Rock. Section 5. The acceptance of the terms of this franchise by the Farmers Curb Market, Inc., shall be endorsed upon the margin of the Record Book wherein this ordinance shall be recorded and such endorsement shall be the only writing necessary to place this ordinance into full force and effect.
