AN ORDINANCE RENOUNCING AND RELINQUISHING
ALL RIGHT IN THE CITY OF LITTLE ROCK OR
THE PUBLIC TO THE USE OF CERTY:IN LAND AS
A PUBLIC ROAD, SAID LAND LYING IN EDGEHILL
ADDITION TO THE CITY OF LITTLE ROCK, ARK.
WHEREAS, there is presented to the City Council of the City
of Little Rock, Arkansas, the petition of Walter G. Hall asking that
the City Council on behalf of the public, renounce any claim to the
use of a certain strip of land hereinafter described as a public
road; and
WHEREAS, it appears to the City Council that V,�alter G. Hall
owns the unplatted land lying immediately east of this strip of
land and contiguous to the eastern boundary of said strip of land;
that Sun Building and Developing Company owns said strip of land;
that Walter G. Hall had a contract with Sun Building and Developing
(Company requiring said company to dedicate said strip of land to the
public for use as a public road at any time when said company might
plat the land west of said strip of land; and that this contract
was made for the sole purpose of providing ingress into said land
owned by Walter G. Hall, that Walter G. Hall has now agreed to pur-
chase, and said company has agreed to sell to Talter G. Hall, plot
Sixty -two (62) of Edgehill Addition to the City of Little Rock,
Arkansas, being the land lying immediately west of said strip of
land; that the Sun Building and Developing Company and the owners
of all plots designated. in the Biil of Assurance which dedicated
said strip of land as a public road have executed quitclaim Deeds to
'halter G. Hall in which they renounce, disclaim, release and relin-
quish to Walter G. Hall any and all right, title or interest to the
above described real property arising by virtue of the dedication
of said real property to the public for use as a road, that the
dedication of said strip of land to the public for use as a road

has never been accepted by the City of Little Rock or by any public
body nor has it been accepted by the public by any use thereof; that
no roadway has ever been opened over said strip of land; and the use
of said strip of land as a road is now, and has at all tunes been
impossible because of the growth of large trees on said strip of
; that, furthermore, it is not within the realm of practical
ssibility that said strip of land could ever be used for a through
d to connect with Cantrell Road because at the northern end of
said strip of land there is a sheer rock cliff constituting a drop
f twenty -four (24) feet to Cantrell Road.
NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK:
SECTION I. That the City of Little Rock, for and on behalf
of the public, hereby renounces, disclaims and relinquishes any and
1 right, title or interest it may have to certain land situated
the City of Little Rock, County of Pulaski, State of Arkansas,
o -wit:
Certain land described in a Bill of Assurance which pro-
vides with respect to Plot Sixty -two (62) and other plots
in Edgehill Addition to the City of Little Rock, Arkansas,
the same being dated August 27, 1930, filed for record on
August 27, 1930, in the office of the Circuit Clerk,
Pulaski County, Arkansas, and now appearing of record in the
Record of Deeds cf Pulaski County in Book 209, at Page 5.36,
said land being therein described as "a strip of land twenty -
four (24) feet wide off of the east or northeast part?' of
the lands designated in said Bill of Assurance, said strip
of land being dedicated in said Bill of Assurance to the
public to be used as a road, and to be known as Brimwood
Road; said strip of land being shown and designated as
Brimwood Road on a plat of Edgehill Addition to the City of
Little Rock, Arkansas, filed in the office of the Circuit
Clerk of Pulaski County, Arkansas, on August 27, 1930, and
now appearing of record in the Plat Record of Pulaski County,
in Book #3, at Page 129; said stri of land being actually
Twenty -four and seven - tenths (24.7y more or less feet in
width and being all of the land lying between the eastern
boundary of Plot Sixty -two (62) of the Aforesaid Edgehill
Addition and the western boundary of the unplatted lands
owned by Walter G. Hall.
SECTION II. That the above described land is hereby abandoned,
cated and closed as a public easement or road.

SECTION III.�,Zhe relinquishment and release to Walter G.
Hall of any right, title or interest in the above described land by
the Sun Building and Developing Company and the owners who have pur-
chased plots designated in the Bill of Assurance which dedicated
the above described land for use as a public road is hereby accepted
and agreed to.
SECTION IV. That all ordinances or parts of ordinances in
conflict herewith are hereby repealed only insofar as they effect
this ordinance.
