HomeMy WebLinkAbout5136ORDINANCE NO. 5136 AN ORDINANCE PROVIDING FOR THE EXAMINATION OF APPLICANTS FOR LICENSES TO OPERATE STEAM BOILERS AND /OR REFRIGERATING MA- CHINES; PROVIDING FOR THE APPOINTMENT OF EXAMINERS; FIXING THE LICENSE FEES FOR SANE, AND FOR OTHER PURPOSES. BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. The Mayor of the City of Little Rock is hereby authorized and directed to appoint a Board of Examiners, who shall serve without pay, to examine all engineers who oper- ate stationary steam boilers with twenty -five (25) pounds of steam pressure or more, or steam boilers attached to hoisting machines and /or commercial ice or refrigerating machines of fifteen tons (15) or more, and /or refrigerating machines of five tons (5) or more used in public buildings. The said Board of Examiners shall consist of three (3) members, each of whom shall be skilled in the operation of both boilers and re- frigerating machines as herein described, and shall have at least five (5) years' experience in the operation of same, and it shall be the duty of said Board to examine all applicants for licenses to operate such boilers and /or refrigerating ma- chines within the City of Little Rock. It shall be the duty of the said Board to make proper rules and regulations governing the conduct of examinations of applicants, and to make and con- duct investigations for the purpose of the enforcement of this ordinance, and to report violations of this ordinance to the duly constituted legal authority of the City of Little Rock. SECTION 2. As designated by the Mayor, one member of said Board shall hold office until May 1, 1935; one member until May 1, 1936; and one member until May 1, 1937. Their respective successors shall thereafter be appointed for a term of three years. ;f SECTION 3. Until a license has first been procured, no person shall operate, or assist in the operation of, any boiler, or boilers, of any kind whatsoever, or for any purpose, when such boiler `has a steam capacity of twenty -five (25) pounds of steam pressure, or more, or operate, or assist in the operation of, any refrigerating machine of fifteen tons (15), or more, used in commercial plants, or refrigerating machines of five tons (5), or more, used in public buildings, in the City of Little Rock; provided that miniature boilers are exempt from this ordinance. A miniature boiler is described to em- brace fired pressure vessels which do not exceed the following limits: Sixteen (16) inches inside diameter of shell, forty - two (42) inches in length of shell, twenty (20) square feet of heating surface, one hundred (100). pounds per square inch max- imum working pressure. SECTION 4. Every such applicant who shall present himself for examination before said Board of Examiners shall pay a fee of three dollars ($3.00). SECTION 5. Every person who is now operating any of the boilers and /or refrigerating machines included in this or- dinance shall be licensed to operate said boiler and /or re- frigerating machine without examination by making application to said Board within thirty days after written notice is given such person by said Board, and by paying to the City Collector of the City of Little Rock a fee of $1.50. -2- SECTION 6. Examinations shall be held by said Board during the month of July of each year, and oftener at the dis- cretion of the Board, and if upon examination, a majority of the Board deems an applicant qualified to operate steam boilers and /or refrigerating machines aforesaid, said applicant shall be granted a license in his proper classification, in the classes herein set out, to extend to the end of the calendar year for which it is granted; First Class: to operate any and all classes of steam and refrigerating machines. Second Class: to operate steam boilers of forty 70-7— orse power, or less, capacity, and refrig- erating machines of fifteen (15) tors, or less, capacity, provided that the holder of a license as a second class engineer may operate all classes of steam boilers and /or refrigerating machines as an assistant to the holder of a first class engineer's license. SECTION 7. The license fees herein provided for shall be payable,. on January 1st of each year, and shall, together with the fees paid by applicants, go to the general revenue fund of the City of Little Rock. SECTION S. Any person who shall have been granted such a license may have the same renewed at the beginning of each calendar year by paying a fee of $1.50 to the City Collect- or of the City of Little Rock, and it shall be the duty of the City Collector to endorse such renewal date and receipt of pay- ment upon the said license. SECTICN 9. The Board of Examiners shall furnish to the City Collector a list of the names of all persons granted such licenses, and the location of the boiler and /or refriger- ating machine such person is operating, and when such holder of a license shall begin work at a different location, it shall be his duty to notify the City Collector in writing. SECTION 10. Upon affidavit of the holder of such license that it has been lost or destroyed, the City Collector shall issue a copy of said license to the person making such affidavit, provided the name of such person appears upon the regular list of license holders in the City Collector's office. SECTION 11. It shall be unlawful for any person to operate, attempt to operate, or assist in the operation of, any boiler and /or refrigerating machine defined and included in this ordinance without having first complied with the provisions of this ordinance. SECTION 12. Any person violating the provisions of this ordinance shall be guilty of a misdemeanor, and upon con- viction, shall be fined in any sum not less than $10.00, nor more than $25.00, and each day such violation shall continue shall constitute a separate offense. SECTION 13. If any section, or sections, of this ordinance shall be declared void by any court of this State, that fact shall not affect the remaining sections of this ordinance, but they shall.continue in full force and effect. SECTION 14. Ordinance is hereby repealed, and all other dinances in conflict herewith are ordinance shall be in full orce passage and approval.
