HomeMy WebLinkAbout5208ORDINANCE NO. 5208 AN ORDINANCE TO AUTHORISE THE BOARD OF PUBLIC AFFAIRS TO PURCHASE LOTS ONE AND TWO,BLOCK TEN,SHELDON'S ADDITION TO THE CITY OF LITTLEROCK,FOR A SUM NOT IN EXCESS OF TWENTY ONE HUNDRED ($2100) DOLLARS AND TO EXECUTE A LEASE FOR A PORTION OF SAME TO THE CAPITAL TRANSPORTATION COMPANY 70 BE USED AS A TURIN- AROUND TRACK AND FOR OTHER PURPOSES. SHIEREAS, It is necessary for the safety, comfort and convenience of the traveling y,ublic that the turn- around tracks of the Capital Transportation Company, successors to the Little Rock Traction & Electric Company, novi situated in the intersection of 25th & Summit streets be eliminated, and .'HEREAS, said company has agreed to remove said turn - around tracks to 211th & Summit Streets, should the necessary space be provided, THEREFORE BE IT ',`RDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK: 177117n-N 1. That the Board of Public :affairs, is hereby authorized and directed to purchase Lots One and Two, Block Ten, Sheldon's Addition to the City of Little -ock, for a price and sum not in excess of Twenty One Hundred ($2100) Dollars, title of same to be taken in the city of Little mock. SECTION 2. That the said Capital Transportation Company shall advance without interest charges, to the City of Little Rock, and pay -,o the Oity 'treasurer, the sum of Twenty Cne Hundred ($2100) Dollars or so much thereof as is necessary for the purchase of said lots mentioned in Section 1 of this ordinance, provided that the said ' "2100 or so much thereof as trill be advanced shall be deducted from and allowed as a credit on the l�ayment of the said Capital Transportation Company's franchise taxes for the year 1935. SECTION 3. That ti:e sum of Twenty one Hundred Dollars, or so thereof ^s --hall be necessary, is hereby a. propriated from the general revenue fund of the city in payment of said real estate and the 'ayor and City Clerk are hereby directed to issue the city's warrant in said amount drawn upon said fund in payment thereof. SECTION 40 The Board of Public Affairs is further authorized and directed to execute a lease to the Capital Transportation Company upon a portion of the land described in Section 1 hereof, in the dimensions of 3eventy feet by ;;event; feet, the exact location of said area to be -1- H determined by the description furnished the said Board of Public affairs by the City Engineer, approved by the engineer for the Capital Trans- portation Company. laid lease agreement srlall be for an annual rental of One (,",1.00) Dollar and shall be executed for the life of the franchise of the Capital Transportation,Com any, as successors to the Little y'ock Traction & Electric Company, terminating in 1951. CECTION 5. The existing tracks in the street intersection of 25th & Summit jtreets, constituting an impediment to motor vehicle traffic and a menace to the life and safety of motorists traveling said Highway, the passage of this ordinance, making possible the elimination of said hazard is immediately necessary, therefore an emergency is hereby declared to exist and t'_^_is ordinance shall take effect and be in force from and after the date of its passage and approval, providing that tj16 said company shall arithin five (5) days thereafter file its acceptance of all the terms and conditions herein, and thereupon the said turn - around track shall become a part of its franchise, and it shall not be required to use the track from there to 25th Street.
