HomeMy WebLinkAbout5235ORDINANCE N0. 5235 AN ORDINANCE AUTHORIZING THE CONSTRUCTION OF A MUSEUM OF FINE ARTS BUILDING UPON LAND OWNED BY THE CITY IN THE LITTLE RO Cn CITY PARn; PROVIDING FOR THE SELECTION OF A BOARD OF TRUSTEES FOR THE aANAGEMENT AND CONTROL OF SAID MUSEUM; PROVIDING FOR THE MEMBERSHIP OF THE BOARD; AND FOR OTHER PURPOSES BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCS, AR °ANSAS SECTION 1. SuJLficient funds having been pledged from private sources and from Federal aid to insure the cost of erection of a suitable museum of fine arts building for the City of Little Rocs, authority is hereby granted for the use of a sufficiently large plat of ground in the Little Rock City Park for the location of said museum building. The Mayor is hereby authorized to allow the construction of said building upon City property located in the Little Roc'' City Par!", provided that said building shall be erected and completed without any cost to the City of Little Rocl -,. And the City of Little Rock hereby expressly exempts itself from any and all liability which might arise by virtue of the construc- tion of said building; it being expressly understood that said building is to be completed without any cost to the City of Little Ro ck . SECTION 2. Upon the completion of said building free of all encumbrance and charges the same shall then revert to and become the property of the City of Little Rock provided that upon the completion of said building free of encumbrance and cost to the City of Little Rock that the said City of Little Rock by the passage of this ordinance does agree to assume the cost of main- tenance of said museum and its exhibits, it being expressly under- stood that the cost of maintenance will include the lighting, heati rg , cleaning, necessary caretaking and supervision of the building and the exhibits. SECTION 3. The exclusive management and control of said museum of fine artsis hereby vested in a Board of Trustees to be composed of nine (9) members as follows to -wit: The Mayor of the City of Little Rock and the President of the Fine Arts Club of Little Rock shall be ex- officio members of said Board of Trustees. -2- F. W. Allsopp is hereby designated a life member of said Board; provided that upon his death or resignation his successor shall be elected for a term of six (6) years and thereafter such term of office shall be for a period of six (6) years. Mrs. Frederick Hanger is hereby elected a member of said Board for a period of one (1) year. Mrs. F. B. T. Hollenberg is hereby elected a member of said Board for a period of two (2) years. Mr. George B. Rose is hereby elected a member of said Board for a period of three (3) years. Mrs. C. M. Taylor is hereby elected a member of said Board for a period of four (4) years. Mrs. Fran's Tillar is hereby elected a member of said Board for a period of five (5) years. Dr. Frank Vinsonhaler is hereby elected a member of said Board for a period of six (6) years. Upon the expiration of the term of office of the members hereinabove designated the term of office of the successors shall be for a period of six (6) years and such elected shall be by the other members of the Board of Trustees. Upon the death, resigna- tion or disqualification of any trustee his successor shall be elected to fill out the unexpired term of the trustee succeeded. SECTION 4. The members of the Board of Trustees shall serve without pay or compensation in any form. Immediately upon the appointments of said Board of Trustees they shall proceed to organize by the election of a Chairman and Secretary and such other officers as the members of said Board may deem necessary. The Board of Trustees shall have the power to adopt rules and regulations governing the management and the operation of said museum of fine arts. The Board of Trustees shall annually mare a report showing the work and activity of the Board for the year. -3- SECTION 5. That the gallery is to be the home and meeting place of the Fine Arts Club at all times. It will continue its wor' -c of promotion and perpetuation of a Fine Arts spirit and the collection of works of art for the gallery. SECTION 6. If the City fails or refuses to provide for necessary funds to care for the maintenance of the said Museum of Fine Arts Buidling then in that event after the expiration of thirty (30) days notice to the City Council that such failure or refusal exists, the maintenance of said building may be as- sumed and ta=Ken over by the Fine Arts Club of Arkansas. SECTION 7. WHEREAS the construction of said Fine Arts Building will provide employment for persons now unemployed and in addition wi.l provide for the cultural development of the citizens of the City of Little Rock the same is found to be necessary for the immediate preservation of the public peace, health and safety and an emergency is therefore declared to exist and this ordinance shall be in full force and effect from and after its passage and approval. r Passed :._, Attest: City Clerk Approved: Mayor.
