AN ORDINANCE TO PROVIDE FOR THE INSPECTION OF ALL PRODUCE,
FISH, FRUIT, VEGETABLES, POULTRY, AND /M PROVISI TS SOLD
OR DELIVERED WITHIN THE CITY OF LITTLE ROCK; PRORIDING A
PENALTY FOR THE VICLATION THEREOF'; FIXING THE INSPECTICH
FEES; PRMIDING FOR THE APPMNTMENT -OF INSPECTORS; AND FOR
OTHER PURPOSES
WHEREAS, fruits: vegetables, fish, poultry, and other
provisions are being sold, offered for sale, and delivered
within the City of Little Rock which are of inferior
Quality and unfit for human consumption, and;
WHEREAS,the health of the citizens of Little Rock is therefore
affected and should be protected by inspection and regula.

poultry, fish, and other provisions where same are offered
for sale by persons, firms, and /or corporations not having
a fixed and established place of business within the City
of Little Rock, and;
.� WHEREAS, such articles should be inspected and graded as

NGN9 THEREFORE, BE IT CMKNED BY THE CITY COUNCIL OF THE
e. CITY OF LITTLE ROCK, ARKANSAS:
SECTT CK 1i From and after the passage and approval of this 00dinance,
it shall be unlawful for any person firm and /or corporation, to sell,
offer for sale and/ or deliver within the City of Little Rock, any
produce, fish, fruits, poultry and /or other provisions without first
having such produce inspected and receiving a certificate therefor,
from the proper inspector as herein after provided.
SECTI..�C[J �2.s. The certificate to be issued in duplicate after inspection
is made and approved, One (1) to be retained by the inspector,
one (1) by the inspected person, firm or corporations)
The certificate must contain the following information:
Time and place of inspection, date, name and address of the dealer,
the kind of conveyance used, and an approximate list and description
of articles or produce inspected, such certificate to hold good for
only one calendar day where such fruits or other produce remains
on trucks, wagons or other conveyance.
SECTION 3.; Produce as herein defined sold or offered for sale by
persons and /or corporations having a fixed and established place of
business for which a privilege tax has been paid to the City of
Little Rock, shall be inspected daily by a designated inspector and
such person, firm, and /or corporation shall pay a fee of Fifty Dollars
($50600) per year for such inspections, Each such person, firm, or
corporation so inspected will be given a certificate after each such
inspection.
SECTION 4_ The fees to be paid by said dealers or others to the
inspector or inspectors so designated by the City of Little Rock, are
as follows:
1.{ Citrus fruits and /or other provisions or produce out
of season, Two and one -half (2-L)¢) per bushel, or Five Cents (5¢)
per 100 pounds with a minimum of Two Dollars and Fifty Cents (20150)
per truck load.
Where such fruits and /or other produce is inspected in
railroad car, a fee of from Five Dollars ($5,00) to Ten Dollars
($10,00), shall be charged.f
All other fruits, fish produce or other provisions shall
be charged a fee of Five Cents (5; minimum:, to Fifty Cents (5(4e)
maximum* per load, the inspector to be the judge. as to the fee charged
The inspector in charge shall have the right to issue a certificate
without charge shouted, in his opinion, the person asking for an

inspection be unable to pay for same because of some unforeseen
condition that may arise.
SECT CCN 5 , A,,ny persons firm or corporation buying$ possessing for the
purpose of sale, selling# or offering for sale any produce, fruits
or other provisions which have not been inspected is herein provided
shall be deemed guilty of a misdemeanor and upon conviction shall be
fined as herein provided,1 Any persons firms and /or corporation
found guilty of violation of any provisions of this ordinance shall
be deemed guilty of a misdemeanor and upon conviction thereof$ shall
be fined in amy sum not less than Ten Dollars ($1GoOO) nor more than
Fifty Dollars ($50.00) for the first offenses and each such violation
shall be a separate of f ense e
SECTION 6& The Mayor is hereby authorised to appoint two (w.) or
'r more inspectors to inspect such produces fruits$ fish and /or other
provisions in accordance with the provisions of this ordinance and
to otherwise supervise and enforce this ordinance.
The Mayor and Market Committee shall select and designate
an inspection depot to be kept open such hours as the Market Com-
mittee of the City Council of the City of Little Rock* may select.
It is hereby made the duty of all personsq firms and corporations
engaged in the business of selling$ offering for sale$ or delivering
within the City of Little Rock* Arkansas$ any articlesspecified
in this ordinance to present such articles at said depot for said
inspections in accordance with the terms of this ordinance,;
SECTION T&- The fees herein provided for, shall be paid into the
City Collootor who shall keep such funds or fees in a separate

provided that no expense shall be incurred by the City for the
enforcement of this Ordinance which will be in excess of the revenue

SECTION S,1 If any provision of this Ordinance shall be declared
.� unconstitutional and void by a court of a competent jurisdictiono
such invalidity shall not affect the remainder of the Ordinance*
SECTION 9& Ordinance Number 4972 is hereby expressly repealed.
Section 10* The proper inspection of articles of food being necessary
o, t e preservation of the health of the citizens of Little Rock$
an emergency is hereby declared to exist and this Ordinance is found
to be necessary for the immediate preservation cf the public peace$
health$ safety and the same shall be in full force and effect from
and after its passage and approval*
