AN ORDINANCE FOR THE SALE OF 'v`ATER TO ARKANSAW WATER
COlIIPANY FOR SUPPLYING NORTH LITTLE ROCK AND FIXING THE
RATES TO BE PAID THEREFOR.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK:
Section 1. The City contracts with the Arkansaw
Water Company to supply and sell to Arkansaw Water Company
for the period of twenty years from this date all water need-
ed by said Company to supply its consumers in the City of
North Little Rock and its vicinity, at the following rates:
Five cents per 1,000 gallons during the period
the City is required to pump water so supplied from the Ar-
kansas River and wells; and
Four cents per 1,000 gallons from and after the
time the proposed Alum Fore supply is placed in service.
Such water shall be delivered to the Arkansaw Mater
Company at the venturi meter located in the old City Electric
Light Plant or at such other point on the pipeline of the
Arkansaw dater Company on the south side of the Arkansas
River, used for service to North Little Rock, as the City
shall select and install a meter. Readings of the meter to
be monthly, and settlement thereof to be wade by the Arkansaw
T'ater Company with the City on or before the fifteenth day
of each month for all water supplied in the preceding cal-
endar month. The Company shall have the right to inspect
said meter at all reasonable times, and to have a represen-
tative present at the meter readings.
Section 2. This contract shall inure to the ben-
efit of the Arkansaw Water Company, its corporate successors
and assigns where the common stock ownership in such successor
or assignee is substantially the same as it is now in the Com-
pany; but this contract shall terminate, and all rights and
obligations of each of the parties hereunder shall be at an
end, should the Company sell its North Little Rock plant and
system to the City of North Little Rock, or to others where
the common stock ownership of the assignee is not substan-
tially the same as it is now in the Company.
Section 171. Acceptance of the contract embodied in
this ordinance by the Company shall be evidenced by its sig -$
nature on this ordinance, or on the copy thereof recorded by 4:
the City Clerk in his Ordinance Book.
Section 4. It is found and declared that the Ar-
kansaw :`:`ater Company is an important customer for dater to �1
be supplied by the City from the waterworks system the City /
has agreed to purchase, and the making of a definite con-
tract with the Arkansaw Water Company provided for in this \
ordinance is necessary in the financing of said project by 06r
the City, and that the financing of said project is necessary
to be consummated immediately and without delay, and that the
said project will immediately tend. to relieve the conditions
of unemployment of labor in the City, and that the making of
the contract embodied in this ordinance is necessary for the
immediate preservation of the public peace, health and safety;
and an emergency is declared to exist, and this ordinance
shall take effect and be in force on and after its passage.
