HomeMy WebLinkAbout5537ORDINANCE'-' NO. AN ORDINANCE PROVIDING FOR AN ANNUAL PELIVILEGIR, TAX. ON DEALERS, IN COAL AT'D COKE; AND FOR OTHER PURPOS IS. DE IT ORDAINED by the City Council of the City of Little hock, Arkansas, as follows: Section 1. That the followinE. schedule be and the same is hereby declared to be the schedale of annual privilege licenses for engaging in or carrying on the kind of business as hereinafter designated and defined, in the City of Little Hock, Arkansas, during the year 1938 and subsequent years. Each and every person, firm, corporation, association or company engaged in the following ousiness, within the corporate limits of the City of Little mock, Aransas, shall pay for and take out such licenses in such sums for the business set out and defined as folloYis: COAL YARD. Each coal yard or dealer in coal or coke either wholesale or retail, or both, regularly engaged in the delivery of coal or coke to retail consumers, and possessing unloading storage, delivery, sales and service facilities ade- quate to the needs of the retail trade area served, and equipped with and using an approved wagon or truck scale of sufficient . size and capacity to accurately weigh the maximum gros.� load of the vehicles used in such d:-Ilivery; and maintaining an office accessible to and open to the public during reasonable business hours of each day, except Sundeys, with a competent person on duty, therein,- - - - - - - - -- - - - - - - - - - - - `k50.00 per annum ITIN ?;lkhNT COAL ! each itinerant person, firm or corporation dealing in, selling or delivering coal or coke, either Wholesale or retail, or ooth, and not maintaining unload - ing, storage, sales, weighing and service facilities as herein - above last set forth and defined for a 'Coal Yard ", and any agent, salesman, or deliveryman; for any such itinerant dealer - - - - - - - - ,50.00 per annum Section 2. That no license issued under the above schedule can be transferred except by consent of the City Council. Section 3. That the above schedule of licenses shall be for the.calendar year 1938 and for each calendar year there- after, e:�-cept in case the license be taken out on or after the first day of July, when only one -half of the license shall be char-:ed and collected. ''here a license is issued to a person, firm, and /or corporation operating more than one wagon, truck, or other vehicle, t.,en all such vehicles shall be operated in the name of such person, firm, and /or corporation, and all licenses shall be issued to such person, firm, and /or corpora- tion. If any truc'T license is issued to any other person, firm, an /or corporation, then a separate lic_nse shall be required. erection 4. That each holder of a license issued under this ordinance shall ke;p on display in his place of business or delivery vehicle, that the same may be inspected by the officers and officials of the _'ity of 1,ittle Rock., Arkansas. section 5. That the license required under this Ordinan.;e shall be taken out and paid for before any business, for which they are required, is engaged in. Page 2. erection 6. That any person who engages in any of the businesses, occupations or professions, or who shall keep any establishment or other thing, or do any business act for which a license is required, without having paid such license charge and obtained a license from the City 'Collector, as provided by this ordinance, shall be guilty of a misdemeanor, and on conviction shall be fined not less than ten, nor more than one hundred dollars, and may oe imprisoned in the city prison or put to hard labor for the city for not more than sixty days and each day that a business, occupation or profession is engaged in without a License as provided for in this ordinance shall constitute a separate offense. iDection 7. That where any person, firm or corporation is subject to the payment of a city license tax due the amity of Little ;ock, Arkansas, and has failed or refused to pay the sum then any officer, agent, servant, or employee of such person,' firm or corporation, A,ho undert=akes to carry on such business for said person, firm or corporation, for which a -license is required, shall be guilty o� a misdemeanor and shall be fined not less than ten dollars nor more than one hundred dollars, and may be imprisoned in the city prison for not more than sixty days and each day that any officer, agent, serv..nt or employee undertakes to carry on such business for such person, firm, or corporation shall constitute a separate of'ense. )ection 8. That all ordinances, or parts of ordinances in conflict 1-!ith the foregoing -,,re hereby repealed. .section 9. HEREAS, This ordinance is for the protection of the citizens of Little Rock, and emergency is hereby declared to exist and this ordinance is found to be necessary for the pre- servation of the public peace, health and safety, and the same shall be in full force and effect from and after its passage and approval.
