AN ORDINANCE W PROVIDE FOR THE VACATING AND CLOSING OF Tii ALLEY RUNNING THROUGH BLOCK TWO ' Oj nTZGBRALDIS ADDITION TO THE E CITY OF LIT%J ROCK, PULASKI COUNTx ARKANSAS. WHEREAS, a petition was filed more than ten days ago in .the office of the pity Clerk by ten property `dlrtei in the City of Little Rack, including John B. Morris, Bishop of Little Rock, the owner.of the whole of Block Two (2) of Fitzgerald's Addition to the City of Little Rock, Pulaski County, Arkansas, stating that the alley through said Block has never been used since its dedication to the public, that when the hospital known -as Saint Vincent Infirmary was erected on said _Block many years ago the land covered by said alley was needed and used, and said alley closed in;facp, and further stating 1h 30 mmik s need f land embraced in said alley by reason of an addition to said- by pital now in the process of construction•, f WHEREAS,, a notice was published more than ten days ago by the City Clerk in a newspaper of general circulation in this City calling on abutting,property owners and all other persons, firms -and corporations to .appear before the Council at this, a r6gular meeting of said City Council, to show cause why the petition should not be .greeted; WHEREAS, the said petition has been read aloud aAd present invited to protest or objoet, ud no rot 0', 'r } or objection has been made; and it is found hereby that said petition is signed by ten owners of real property in this `City_ and tit petitioner John B' Morris, Bishop of Littleol� .is. 'Block, and t hat it is desirable and necessary to close said alley; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. That the petition prayi1g for the closing of the alley running through Block Two (2) of Fitzgerald's Addition to the City of Little Rock, Pulaski County, Arkansas, be and it is granted hereby, and the whole of said alley is vacated and closed, cancelling and rescidding the rights of the general public and abutting property owners to use the land embraced in said alley, and their rights are cancelled and barred forever, and the title to the land embraced in said alley is free forever of the right of all persons to use said land as an alley hereby. Section 2. It is found hereby that by reason of the absence of a formal vacating and closing of said . a .r,44!py _4ggording to law i delaying the construction of a valuable addition to Saint Vincent Infirmary, which will lend employment to man le and the sale of much e y people p goods in the City, thereby endangering the public peace, health and safety in delaying the lawful closing of said alley; and an emergency is found and declared to exist; and this ordinance shall be in full force and effect from and after its passage.
