HomeMy WebLinkAbout206941 ORDINANCE NO. 20,694 2 3 AN ORDINANCE TO AMEND LITTLE ROCK, ARK., ORDINANCE NO. 4 17,779 (JULY 7, 1998) TO DECREASE THE SIZE OF THE 5 CONSTRUCTION BOARD OF ADJUSTMENT AND APPEALS FROM 6 SEVEN (7) TO FIVE (5) MEMBERS; AND FOR OTHER PURPOSES. 7 s WHEREAS, Section 112 of the City's Building Code requires that there be a Board of Appeals made 9 up of experienced trained individuals to pass on issues that deal with building construction; and, 10 WHEREAS, a reduction of the current Board from seven (7) members to five (5) members would not 11 be an undue hardship, particularly since the Board has only had to hear one (1) appeal in the last four (4) 12 years; and, 13 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE 14 CITY OF LITTLE ROCK, ARKANSAS: 15 Section 1. Section 1 (A) (1) of Little Rock, Ark., Ordinance No. 17,779 (July 7, 1998) is hereby 16 amended to read as follows: 17 Membership 18 This Board shall consist of five (5) members with expertise in dealing with the 19 various City Codes. The members shall include persons who possess training and 20 experience as set forth below: 21 a) A registered architect; 22 b) A licensed building contractor; 23 c) A registered electrical engineer; 24 d) A licensed mechanical or plumbing contractor; 25 e) A registered mechanical engineer; 26 f) A licensed master electrical contractor; or 27 g) A registered structural engineer. 28 No Board Member shall be permitted to sit in any case in which that member has a 29 personal or financial. interest in the manner under consideration. No Board Member shall 30 be an employee of the City. 31 Term of Office 32 Each member shall serve a term of four (4) years and may be reappointed for an 33 additional four (4) -year term. Section 4. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining provisions of this ordinance, as if such invalid or unconstitutional provision were not originally a part of this ordinance. Section 5. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this ordinance are hereby repealed to the extent of such inconsistency.
