HomeMy WebLinkAbout5770ORDINANCE # 5770 AN ORDINANCE DECLARING THE BUSINESS OF ENGAGING IN PRODUCTION AND /OR 114ANUFACTURE AND /OR SALE OF BAKEEY P_;�ODUCTS AND THE BOTTLING OF SOFT DRINKS TO BE A PRIVILEGE; FIXING A PRIVILEGE TAX THERE- FOR; PROVIDING A PENALTY FOR THE VIOLATION HERE- OF; AND FOR OTHER PURPOSES �BS IT ORDAINED BY THE CITY COUNCIL OF-THE CITY OF LITTLE ROCK, ARKANSAS SECTION 1. From and after the passage and approval of this Ordinance, the business of engaging in the sale, production, and /or manufacture of bakery products and the bottling of soft drinks at wholesale, is hereby declared to be a privilege and before any person, firm, or corporation shall engage in said business, they shall apply to the City Collector for a license therefor and pay a license fee as hereinafter set out. SECTION 2. The license fee for the business of the bottling of soft drinks at wholesale shall be as follows: (1). Plants having a rated capacity up to Twenty -four (24) bottles per minute shall pay an annual tax of (2). Plants having a rated capacity of Thirty -eight (38) bottles per minute shall pay an annual tax of Two Hundred Twenty Dollars ($220.00). (3). Plants having a rated capacity of Forty -eight (48) bottles per minute shall ay an annual tax of Two Hundred Fifty Dollars (1250.00). (4). Plants having a rated capacity of One Hundred Twenty (120) bottles per minute shall pay an annual tax of Six Hundred Dollars ($600.00). SECTION 3. The license for the business of engaging in aR .W11 .the sale, production, and /or manufacture at wholesale, of bakery products shall be Two Hundred Fifty Dollars ($250.00) per year., SECTION 4. The license for the business of conducting a wholesale warehouse for the storage of bottled water and bot- tled soft drinks shall be One Hundred Dollars ($100.00) per year.' :SECTION 5. The City Collector shall furnish forms for the reports of said businesses, which form shall be submitted an- nually at least Thirty (30) days prior to the date that the pri- vilege tax is due. It shall be the duty of each person, firm, or F r "> -2- corporation subject to this license fee to fill out said forms under oath and to return them to the City Collector at least Ten (10) days before said privilege tax is due. The City Collector, or his duly authorized Deputy shall have the right to check, at any reasonable time, the books and records of any person, firm, or corporation required to pay said privilege tax to determine whether or not said return is correct. SECTION 6. Any person, firm, or corporation violating any of the provisions of this Ordinance shall be deemed guilty o a misdemeanor and upon conviction in the Little Rock Municipal Court shall be fined in any sum up to and including twice the amount of the license fee due. SECTION 7. WHEREAS; the City of Little Rock is revisir its privilege tax schedules in order to more equitably distribute) its tax burden and the businesses herein set out should pay their just portion of the tax burden in order to aid the City in con- tinuing necessary health and police services, an emergency is hereby found to exist and this Ordinance is found to be necessary for the immediate preservation of the public peace, health, and safety, and the same shall be in full force and effect from and after its passage, approval, and publication.
