It shall be unlawful for the owner or operator of any motor- driven vehicle to use or permit the use of such vehicle in the business of transporting per- sons for hire over a regular route or upon a regular schedule of operation from points within the city limits of the City of Little Rock to points within a radius of five miles be'- yond such corporate limits, with or without occasional trips of ten miles beyond such corporate limits, without first obtain a license therefor from the City 06% the City of Little Rock and paying the tax for that privi- loge herein provided, and conforming to this ordinance -in other respects. SECTION 2. Any person or persons or corporation desiring to engage in the business provided for in Section 1 of this ordinance shall file an application therefor with the- City Clerk, in which shall be set forth a descripti.. wf . e motor vehicle or vehicles proposed to be aper$t persanf persons, or corporation, the route sad -ter i "$ nP +value of hi c tnntnr vphielp bath within And outside _the- charge for the service; and shall deposit with the City Clerk, to be passed to the City Treasurer, the sum of Thirty Dollars ($30) to'be applied as a prepayment of the monthly, license fee herein provided for for-the first six months if, the license applied for is granted, but to be returned to the applicant if the license is not granted. SECTION Z. Upon the filing of such application and the making of the deposit herein provided for, the City Clerk v - 4 00, Sic" Cc�t�tte of the City Council and that Committee shall investigate the* matter of the application and report thereon to the City Council. If the City Council,approves the application, it shall pass a resolution or ordinance evidencing that fact, and shall order a license to be issued by the City Clerk to the A I applicant; and in such resolution or ordinance shall be fixed the..; route and termini the applicant will be permitted to use both within and without the City in the operation of his motor vehicle. SECTION.4. For each motor vehicle licensed to operate hereunder the licensee shall pay the City a license fee or tax of Five Dollars ($5) per month, payable in advance on or before the first day of each calendar month. I SECTION 5. The licensee hereunder of any and all motor vehicles engaged in the business described in Section 1 of this ordinance-shall keep such motor vehicles in good re- pair and in a clean and sanitary condition. SECTION S. It having been }questioned whether tie I f City has an ordinance requiring a license for the operation of G motor vehicles -as common carriers from points within the city to points within five miles of the city limits on regular schedules, and there having been instances of operations of that kind without the operator securing such license or paying any license fee or submitting to any regulation, and in one J ,r Ordinance case a temporary injunction having been issued by a court re- straining prosecution for engaging in the business described in Section l of this ordinance without a license, and the fact being that parties engaging-in, zncsh business not licensed and "Ulm* a dity Ad the �lemt w tecl b7 " authority creates &,condition of.present danger to some of the inhabitants of the city in the unregulated use of the city streets for private profit and such unregulated common carriers giving opportunities for dissipation and immorality and such vehicles not being subject to mechanical safety and sanitary regulation and being a menace to the safety and health of their passengers, . it is found that the immediate operation of this ordinance is necessary for the immediate preservation of the public peace, health, and safety, and an emergency is declared , thi3'ordi:harice shall take effect and be in force on and after its passage.
