AN ORDINANCE TO PROHIBIT ANY PERSON, FIRM OR CORPORATION SELLING MILK IN THE CITY OF LITTLE ROCK, ARKANSAS, FROM RECEIVING UNGRADED u1m; TO PROHIBIT ANY PERSON, FIRM OR CORPORATION FROM RECEIVING OR TRANS- PORTING UNGRADED MILK TO ANY PERSON, FIRM OR CORPORATION HAVING A PERMIT TO SELL MILK IN THE CITY OF LITTLE ROCK, ARKANSAS; TO PROVIDE FOR EXCEPTIONS THERETO; TO PROVIDE FOR A PENALTY FOR THE VIOLATION THEREOF; AND FOR OTHER PURPOSES BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. No person, firm or corporation selling milk, either at wholesale or retail to persons, firms and/or corporations within the city limits of the City of Little Rock, Arkansas, shall sell, offer for sale, receive and/or have on the premises of the dairy, or any branch thereof, at any time, any ungraded milk except as provided for in Section 4 of this Ordinance. SECTION 2. No person, firm or corporation shall receive, trans- port, or offer for sale in any manner, either for wholesale or retail any ungraded milk to any person, firm or corporation selling milk in the City of Little Rock, Arkansas, except as provided for in Section 4 of this Ordinance. SECTION 3. The term "ungraded milk" as herein used is hereby defined and meant to include all milk except Grade "A" and Grade "B" milk as defined in Ordinance No. 4405 and Ordinance No. 5145. SECTION 4. Sections 1 and 2 of this Ordinance shall not apply for a period of fourteen (14) days from the date of notice to any dairy holding an unexpired permit (granting permission to sell milk within the City of Little Rock) where such permittee for any reason may have been degraded, provided that during the fourteen days the said permittee observes and complies with the - labeling requirements of 8ipeti6i►_, 4::df Ordinance No. 4405 of the Ordinances of the City of Littlp; Rook, and provided further that the milk is received and handled in compliance with Section 6 of Ordinance No. 5145. SECTION 5. Any person, firm or corporation violating any of the provisions of this Ordinance shall be deemed guilty of a misde- meanor and upon conviction in the Little Rock Municipal Court shall be fined in any sum not less than Ten Dollars (410.00) nor more than One Hundred Dollars (jlOO.00), and each violation shall constitute a sepa- rate offense. Any person, firm or corporation holding a permit to i � .__al - 2 - sell milk either at wholesale or retail to the citizens of the City of Little Rock found in possession of any ungraded milk as herein defined, except as provided for in Section 4 of this Ordinance, shall immediately forfeit its permit and it shall be the duty of the City Health Officer to cancel said permit immediately and see that such person, firm or corporattion does not sell, or offer for sale, milk within the City.of a f Little Rock. The cancellation of the permit shad not relieve the responsibility for prosecution in the Little Rook Municipal Court. SECTION 6. All ordinances and /or parts of ordinances in con- flict herewith are hereby repealed. The provisions of this•ordinance are declared to be severable and if any clause, phrase, or. section hereof should be found to be void such finding shall not affect the remainder of the ordinance.
