AN ORDINANCE TO AMEND CITY ORDINANCE NO. 5535
WHEREAS, theCity of Little Rock, by Ordinance No. 5535,
agreed to do certain work on the property hereinafter described
and to make a cash
payment
in settlement
of damages;-and
WHEREAS,
the City
has made the
cash payment but has
never done the work it agreed-to do, and it now appears that the
original plan is impractical and should be changed;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF LITTLE ROCK, ARKANSAS:
Section 1. That Section 1 of Ordinance No-5535 of
the City of Little Rock, passed and approved on January 10, 1938,
be amended to read as follows:
"Section 1. That in full settlement by and
between. the City of Little Rock, Arkansas, and the
Misses Emily E. Van Frank, Charlotte B. Van Frank and
Sue Marie Van Frank, hereinafter termed Owners, their
successors, heirs and assigns, for all damages sustained
by them by the making of a cut twenty -two feet deep on
the south side of their property fronting on Roosevelt Road
between Scott and Cumberland Streets, being Block Five
(5) of Van Frank1s Subdivision of Block Eighteen (18) of
Rapley Estate, the City of Little Rock will immediately
do the following items:
1. Construct 172 feet masonry wall (12" by 24"), with.
1211 exposed, along North Right -Of -Way line of
Roosevelt Road, or along the South boundary of
Lot 10, Block 5, Van Frank Subdivision of Rapley Estate.
2. Construct 12 cubic yards stone masonry as directed
by Owners.

3. Construct 172 feet wire fence along and on
masonry wall in Item 1, also construct 128
feet fence as directed by Owners. Fence to
be of wire 4 feet in width ( Fones Bros. 1348 -P,
or equal) and with steel posts set on 8 foot
centers, posts to be Fones Bros. Ideal, or equal.
Construct gate complete in fence at location of
concrete steps.
4. Slope bank on l to l slope with toe of slope
at point 15 feet North of curb face on North side
Roosevelt Road and 0.3 feet above top of North
curb of Roosevelt Road. Round off top of slope
on radius of approximately 10 feet and blend top
of slope into present yard surface.
5. Sod slope as completed with heavy Bermuda sod,
sodding solid and to be watered and tamped as
placed.
6. Construct masonry retaining wall, containing
approximately 4.5 cubic yards masonry, as shown
on attached plat.
7. Remove old concrete foundation walls at Southwest
corner of Lot 10.
8. Construct concrete steps in location selected by
Owners, said steps to have risers of six inch
(unless otherwise directed by Owners) and treads
of 12 inches unless otherwise directed by Owners
Section 2. That the City Engineer is hereby authorized
and directed to proceed at once with the work outlined in
Section 1 of this ordinance.
Section 3. That all ordinances and parts of ordinances
in conflict herewith are hereby repealed and this ordinance shall
be in full force and effect from and after its passage.
