PROVIDING FOR A PHYSICAL EXA0INATION OF THE. PERSON FOUND GUILTY OF VIOLATING THE TERM OF THE ORDINANCE;, PROVIDING FOR QUARANTINE AND TREATMENT FOR PERSONS FOUND TO BE INFECTED WITH A VENEREAL DISEASE IN A COMWUNIGAA BLE STAdtF PROVIDING THAT VIOLATION OF QUARAI ?TINE OR FAILURE TO TAKE TREATMENT SHALL BE PUNISEED AS A MISDEIMANOR; PROVIDING PENALTIES AI?D FOR OTHER PURPOSES. BE IT ORDAINED BY TT,7E CITY COTMCIL OF LITTLE ROCK, ARKANSAS: Section 1. Section 1 of Ordinance No. 6249 is hereby amended to read as follows: "Every female who shall, in the City of Little Rock, Arkansas, offer or tender herself for the purpose of prostitution, illicit intercourse, or who shall be in the habit of receiving or making visits therefor shall, together with her male paramour or visitor, be guilty of a misdemeanor and a violation of this ordinance." Section 2. Section 5 of Ordinance No. 6249 is hereby amended to read as follows: " Whenever any person is found guilty of violating Section 1 of this ordinance, such fact shall be reported by the Clerk of the Municipal Court to the City health Officer; and on such conviction, the Munici- pal Judge or the City Health Officer is authorized to cause such per- son to be detained and examined by the City Health Officer or by any physician designated by the City Health Officer by use of the necessary tests and examinations, including the Wassermann blood test, to ascer- tain the presence of any venereal disease in a communicable stage, pro- vided that any evidence so acquired shall not be used against such per- son in any criminal prosecution." Section 3. Section 6 of Ordinance No. 6249 is hereby amended to read as follows: " Any person who, after the examination provided in Section 4 of this ordinance is found to be infected with a venereal disease in a communica- ble stage, and is committed to a hospital or other place of quarantine as provided in Section 5 of this ordinance, and who fails to remain in such place of commitment or other place of quarantine, or any person who fails or refuses to take treatment as prescribed by the City Health Officer, shall be punished as for contempt of court, and shall be guilty of a misdemeanor, and on conviction in the Little Rock Municipal Court shall be fined in any sum not less than twenty -five dollars ($25.00) nor more than two hundred dollars (0200.00)�i a Section 4. If any part, phrase, clause, section, or sub - section of this ordinance be held to be unconstitutional or invalid, such unconstitutionality or in- validity shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed the remaining parts of this ordinance if it had known that such Dart, phrase, clause, section, or sub- section would be declared unconstitutional. Section 5. WHEREAS, the suppression and punishment of vice and immoral practices in the City of Little Rock is w matter of great public concern and direct- ly affects the public health and welfare, an emergency is hereby declared to exist and this ordinance shall be in full force and effect from and after its passage and approval.
