HomeMy WebLinkAbout13646I 2 RESOLUTION NO. 13,646 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO 4 EXECUTE ANY CONTRACT NECESSARY TO ADDRESS THE 5 REMOVAL OF DEBRIS AND OTHER MATTERS CAUSED BY THE 6 DECEMBER 2012, WINTER STORM, WHICH LED PRESIDENT 7 BARACK OBAMA TO DECLARE THE AREA INCLUDING THE CITY 8 OF LITTLE ROCK, ARKANSAS, A NATIONAL DISASTER AREA; TO 9 PERMIT THE CITY MANAGER TO ENTER INTO ANY CONTRACTS 10 COMPETITIVELY BID FOR THIS PURPOSE WITHOUT FURTHER 11 BOARD ACTION, EVEN IF THE AMOUNT OF THE CONTRACT 12 EXCEEDS THE LIMIT OTHERWISE IMPOSED UPON THE CITY 13 MANAGER TO APPROVE PURCHASES; AND FOR OTHER 14 PURPOSES. 15 16 WHEREAS, the City and State of Arkansas suffered damage as a result of a winter storm that hit the 17 state on December 25, 2012, and the extent of this damage led President Barack Obama to declare the 18 area a national disaster area eligible for assistance from the Federal Emergency Management Agency 19 (FEMA); and, 20 WHEREAS, pursuant to City ordinance the City Manager typically cannot approve purchases over 21 the amount of Fifty Thousand Dollars ($50,000.00) without a resolution of authorization by the Board of 22 Directors; and, 23 WHEREAS, it is crucial that contracts be awarded and work begun to clean up the approximately 24 22,000 tons of debris, and repair other damage, caused by the winter storm without any delay whatsoever; 25 and, 26 WHEREAS, a competitive bidding or selection process will be used to hire contractors to complete 27 the recovery work; 28 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 29 OF LITTLE ROCK, ARKANSAS: 30 Section 1. For all contracts that have been the result of competitive bids or competitive selection and 31 are addressed to the repair of damage, or the collection of debris, from the December 25, 2012, winter 32 storm that led to a National Disaster Area declaration that includes the City, the City Manager is [Page 1 of 21 I authorized to award such contract to the lowest responsible and responsive bidder, or to the entity that is 2 deemed to be the most qualified as requested by the City's professional services ordinances. 3 Section 2. The City Manager shall maintain a record of the contracts, and amounts, that are awarded 4 pursuant to this National Disaster declaration, and pursuant to this Resolution, and shall make such 5 information available to the Board of Directors. 6 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 7 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 8 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 9 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 10 resolution. 11 Section 4. Repealer.
