AN ORDINANCE REPEALING ORDINANCE NO. 6283 OF THE ORDINANCES OF THE
CITY OF LITTLE ROCK AND AYENDING SECTIONS 1, 4 and 6 OF ORDINANCE
6249, DECLARING AN EMERGENCY AND FOR OTuER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF LITTLE ROCK, ARKANSAS:
Section 1. Ordinance Rio. 6283 of the ordinances of the City
of Little Rock is hereby repealed ir. its entirety.
Section 2. Section 1 of Ordinance No. 6249 is hereby amended
to read as follows: "Every female who shall, in the City of Little
Rock,, Arkansas, offer or tender herself for the purpose of -rostitution,
Illicit intercourse, or who shall be in the habit of receiving or
making visits therefor shall, together with her male paramour or
visitor, be guilty of a misdemeanor and a violation of this ordinance."
Section 3. Section 4 of Ordinance No. 6249 is hereby amended
to read as follows: "Whenever any person is found Tuilty of violating
Section 1 of this ordinance, such fact shall be reported by the
Clerk of the Municipal "ourt to the City Health Officer; and on such
conviction, the Municipal Judge or the City Health Officer is author -
i.ed to cause such person to be detained and examined by the City
Health Officer or by any physician designated by the City Health
Officer by use of the necessary tests and examinations, including
the Wassermann blood test, to ascertain the presence of any venereal
disease in a communicable state, provided that any evidence so ac-
quired shall not be used against such person in any criminal prose-
cution."
Section 4. Section 6 of Ordinance No. 6249 is hereby amended
to read as follows: "Any person who, after the examino.tion provided
in Section 4 of this ordinance is found to be infected with a venereal
disease in a communicable stage, and is committed to a hospital or
other place of quarantine as provided in Section 5 of this ordinance,
and who fails to remain in such place of commitment or other place
of quarantine, or any person who fails or refuses to take treatment
as prescribed by the City health Officer, shall be punished as for
contempt of court, and shall be guilty of a misdemeanor, and on con-
viction in the' Little Pock Municipal Court shall be fined in any
sum not less than twenty -five dollars (025.00) nor more than two
hundred dollars (4200.00).
Section 5. If any part, phrase, clause, section, or sub-
section of this ordinance be held to be unconstitutional or invalid,
such unconstitutionality or invalidity shall not affect the validity
of the remaining portions of this ordinance. The City Council
hereby declares that it would have passed the remaining parts of
this ordinance if it haJ ant known that such part, phrase, clause,
section, or sub - section would be declared unconstitutional.
Section 6. -1HEREAS, the suppression and punishment of vice
and immoral practices in the City of Little rock is a matter of
great public coneern and directly affects the public health and
welfare, an emergency is hereby declared to exist and this ordinance
shall be in full force and effect from and after its passage and
approval.
