HomeMy WebLinkAbout6506W. 6506 • AN ORDINANCE TO AMEND ORDINANCE NO. b416, KNOWN AS THE "BLACKOUT ORDINANCE"; DECLARING AN LI&RGENCY; AND FOR OTHER PURPUSES. BE IT ORDAINED BY THE CITY COUNCIL OF LITTLE RUCK, ARKANSAS: SECTION 1. That Section b of Ordinance No. b418 passed by the City Council of the City of Little Rock, Arkansas, on the 13th day of April, 1942, and approved by the Mayor, be, and the same is hereby x ' " "amended to read as follows: "Section b. This ordinance shall apply to air raids and to blackouts, including tests or trial blackouts. During; every period of blackout and of air raid alarm, including tests or trial blackouts and alarms, no person shall walk, ride, or be upon any street, highway, avenue, alley, yard, or upon any other open or unenclosed space or platform in the City of Little Rock except: (a) Members of the armed forces of United States and its allies on official business; (b) Officers and employees of the Federal, State of Arkansas, County of Pulaski, or City of Little Rock Governments, carrying identification as such, and being at the time upon necessary official business; (c) „ umbers of the Federal Office of Civilian Defense or of civilian defense units officially designated by proper authority of the State of Arkansas, County of Pulaski, or City of Little Rock, carrying ;identification as such, and being then upon official business; (d) Law enforcement officers of the United States, the State of Arkansas, or of any subdivision of the State of Arkansas, and being then upon official business. "All persons who may be upon any street, highway, avenue, alley, yard, or other open or unenclosed space or platform within the City of Little Rock at the time of the sounding of any alarm provided for in this ordinance shall forthwith and immediately obey, the lawful directions of any members of the armed forces of United States of America charged with the duty of safeguarding lives and property within the City of Little Rock, and they shall further obey the commanas of peace officers of the United'States, the State of Arkansas, the County of Pulaski, and the City of Little Rock, and of officers of any other political subdivision of the State of Arkansas who are charged by law to protect the safety of lives and property within the City of Little, Rock; and they shall further obey the lawful commands of any members of the Federal Office of Civilian Defense, or of members of th6 civilib.n defense units or organizations of the State of Arkansas, County of Pulaski, and City of Little Rock, provided said members shall be then and there carrying identification of their official character. "All Auxiliary Policemen of the Federal Office of Civilian Defense, or of civilian defense units of the State of Arkansas, the County of Pulaski, and the City of Little Rock, regardless of whether they be duly commissioned and acting peace officers, are hereby author- ized and empowered to enforce the provisions of this ordinance, but of none other, during the period of any air raid alarm or blackout, actual or trial, and they shall, during the periods of such alarms and blackouts, and for a reasonable time before and after such alarms and blackouts, have the same powers to act, and they shall act to all intents and pur- poses as peace officers of the City of Little Rock and they are hereby charged with the same duties and responsibilities as peace officers of the City of Little Rock for the times, during the periods, and for the purposes herein mentioned. Said auxiliary Policemen shall not be required to give any security for the performance of their duties, or to take any oath of office, nor shall it be necessary that they be in any manner commissioned by the Chief of Police or the Mayor of the City of Little Rock. They shall enforce the provisions of this ordinance, shall arrest violators hereof when such violations are committed in their presence, shall extinguish or cause to be extinguished all exterior lights and to enter, any room or premises during every period of blackout � A I and period of air raid alarm to extinguish or cause to be extinguished any light which is visible in the open air, and they are authorized and directed to use such force as is necessary to gain entrance in such cases, provided they shall wear such identifying insignia as shall be authorized by the Little Rock Committee on Public Safety, including the official identifying insignia for the civilian defense unit to which they are respectively attached:; provided, they shall not use force to gain e.rrtrance to any building or dwelling during a practice blackout or air raid alarm. "The Chief of Police of Little Rock shall assist in the i enforcement of this ordinance, and he shall detain for safekeeping and trial, any person charged with and arrested for violation of any provision of this ordinance. " SECTION 2. It has been determined that the lives and property of persons in Little Rock are in danger of invasion by the common enemy of the United States of America, and that the safety of said persons and property can be more effectively secured through the medium of this t.eiy- e60411 to the public health and safety of the people of Little Rock, an emergency is therefore declared to exist, and this ordinance-shall take effect 4nd be in force from and after its passage.
