ORDINANCE NO. 6619 AN ORDINANCE REPEALING ORDINANCES NO. 6612 and 6613 OF THE CITY OF LITTLE ROCK, ARKANSAS; AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A LEASE ON BEHALF OF THE CITY OF LITTLE ROCK, LEASING CERTAIN LANDS IN FAIR PARK IN THE CITY OF LITTLE ROCK, ARKANSAS TO THE ARKANSAS LIVESTOCK ASSOCIATION; I,ENTIONING CERTAIN PRO- VISIONS TO E INCORPORATED IN SAID LEASE; DECLARINr AN EMERGENCY; AND FOR OTH R PURPOSES. BE IT ORDAINED BY THE CITY COUI?CIL OF LITTLE ROCK, ARKANSAS: SECTION 1. Ordinance No. 6612 of the Ordinances of the City of Little Rock is hereby repealed in its entirety. SECTION 2. Ordinance No. 6613 of the Ordinances of the City of Little Rock is hereby repealed in its entirety. SECTION 3. The Mayor and City Clerk are hereby authorized to execute on behalf of the City of Little Rock a Lase to the Arkansas Livestock Association covering the following lands in Fair Park in the City of Little Aock, Pulaski County, Arkansas more particularly described as follows: Starting at the intersection of ,Nest Markham Street and Fair Park Boulevard in the City of Little Rock, Arkansas, running west 900 feet; thence south 195.5 feet; thence east 100 feet; thence south 22 degrees east 1310 feet to an asphalt street; thence southeast parallel with said street g distance of 430 feet to a point from which the north end of the arc in Fair Park begins; following an asphalt street cre- ating the are in the meandering direction to the property line of the State Hospital; thence north to the point of beginning. All the rest of Fair Park property except that part being used by the Municipal Zoo, the Municipal Swimming Pool, the Little Rock Base- ball Club, the Fair Park Golf Course and any other portions of Fair Park now leased by the City to any person or persons. SECTION 4. Said lease shall be for a term of one year with an option in the Arkansas Livestock ,Association to renew said lease for a period of one additional year after the expiration of the first year. SECTION 5. The lease authorized in Section 3 of this ordinance shall be subject to all existing leases covering any lands embraced in whole or in part in the premises described in Section 3 of this ordinance; and the City shall expressly reserve the right to renew or remake with the same or different lessees any leases covering those lands embraced in whole or in part in the description set out in Section 3 of this ordinance. . . s-., SECTION 6. The City shall agree that, during the period of the stock show conducted by the Arkansas Livestock Association within the lease period but not to exceed ten (10) days in any calendar year, the Arkansas Livestock Association shall occupy the status of lessor so far as the premises now le ased to T. A. Fuzzell are con- cerned; and that _ during said period as described above not to exceed ten (10) days in any calendar year, the Arkansas Livestock Association shall receive the revenue to which the lessor shall be entitled from the operation of those concessions now covered in a lease made by the City of Little Rock with T. A. Fuzzell. SECTION 7. The lease anticipated in the foregoing sections shall hot be subleased or assigned in whole or in part without the consent of the City of Little Rock; and said lease shall also provide that, in the event that the Arkansas Livestock Association fails to conduct a livestock show on the lease premises during the period of this le ase, the Arkansas Livestock Association shall forfeit and lose the right to a renewal of said lease. SECTION 8. The consideration to be paid by the Arkansas Live- stock Association to the City of Little Rock shall be one dollar (61.00) and the benefits to accrue to the City of Little Rock from the expenditure by the Arkansas Livestock Association of funds in the promotion and holding of a stock show. SECTION 9. ,hereas, the Arkansas Livestock Association is in need of a site on which to hold a state -wide livestock show; and whereas, the furtherance of livestock in the State of Arkansas is vital to the best interests of the State and of the City; and whereas, the City of Little Rock and the citizens thereof will benefit greatly from the holding of a stock show on the premises described in the foregoing ordinance, an emergency is hereby declared to exist and this ordinance, being necessary f or the preservation of the public peace, health and safety, shall be in full force and effect from and after its passage.
