HomeMy WebLinkAbout6657Y 1 ORDINANCE NO. 6657 AN ORDINANCE AUTHORIZING THE MAYOR AND CITY CLERK TO ENTER INTO AN AGREEMENT WITH PULASKI COUNTY, ARKANSAS FOR THE DETENTION IN THE WOMEN'S QUARTERS OF THE CITY JAIL OF CERTAIN WOMEN PRISONERS HELD BY PULASKI COUNTY, ARKANSAS; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF LITTLE ROCK, ARKANSAS: SECTION 1. The Mayor and City Clerk are hereby authorized and directed to enter into the following agreement with Pulaski County, Arkansas: WHEREAS, the County of Pulaski, Arkansas desires to make a contract with some responsible party or parties for the maintenance and safekeeping of certain female prisoners (hereafter known as "prisoners ") held in the name of or under the authority of the State of Arkansas pending a decision as to the disposition to be made of said prisoners; and 1HEREAS, the City of Little Rock, Arkansas is en- larging its facilities for the detention of women prisoners in order that suitable detention facilities will be available for all classes of women prisoners, and WHEREAS, the City of Little Rock, Arkansas is will- ing to accept for maintenance and safe - keeping, said "prisoners" upon the terms and conditions hereinafter set out, THEREFORE, it is agreed by the County of Pulaski, Arkansas and the City of Little Rock, Arkansas: First, the City of Little Rock, Arkansas agrees to accept, maintain and safe -guard in the women's quarters ` of the Little Rock city jail, any and all "prisoners" delivered to the Little Rock city jail by the Ccunty of Pulaski, Arkansas. Second, the City of Little Rock, Arkansas reserves the right to refuse to accept those "prisoners" which in the opinion of the City of Little Rock should not be confined in the w and further reserves "prisoners" from the the women's quarters judgment of the City to capacity. Third, the County cmen's quarters of the city jail the right to refuse to accept County of Pulaski, Arkansas when of the city jail are, in the of Little Rock, Arkansas filled of Pulaski, Arkansas hereby agrees in exchange for the undertakings on the part of the City of Little Rock, Arkansas, set out above, to pay to the City of Little Rock, Arkansas the sum of One Hun- dred and-Thirty-Five Dollars ($ 135.00 ) per months said amount to be paid on the first day of each calendar month for which the payment is due. Fourth, the County of Pulaski, Arkansas agrees to deliver said "prisoners" to the women's quarters of the Little Rock city jail and to call for same and to retake same into custody prior to the time set for the hearing of any charge against each of said "prisoners ". Fifth, the parties to this agreement reserve the right to cancel and terminate any liability under this agreement by giving thirty (30) days written notice thereof to the other contracting party. SECTION 2. Because the maintenance of separate detention facilities for female prisoners arrested in and about the City of Little Rock is necessary t-o the maintenance of law and order; and because the financial assistance to be received from Pulaski County from the agreement set out above is indispensible in the maintenance of the women's detention quarters; and because these facilities and the financial assistance of Pulaski County therein will assist in preserving the public peace, health and safety, an emergency is hereby declared to exist.
