AN ORDINANCE AMENDING SECTION ONE OF ORDINANCE NUMBER 4539; AMENDING
ORDINANCE NUMBER 4960; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES.

BE IT ORDAINED BY THE CITY COUNCIL OF LITTLE ROCK, ARKANSAS:
SECTION 1. Section 1 of Ordinance No. 4539 is hereby amended to
read as follows:

That a City'Planning Commission is hereby created and shall be

to confirmation by the City Council. All members shall serve as such
-Without compensation and members shall hold no other municipal office,
except that the Mayor may appoint one of the administrative officials

of the municipality, and may appoint one or more of the aldermen of
the municipality, not to exceed a total of three aldermen, to serve
upon the Commission, should the Mayor so desire. The terms of the
members appointed shall be for a period of three years, provided, how-
ever, that the appointments in effect on the passage of this Ordinance
shall, at the first meeting following the passage of this Ordinance,
de..termine amongst themselves by lot which three members shall hold +
off oe for a one year term, which three members shall hold office for
a two year term, and which three members shall hold office for a three
year term. The terms of the appointees for the one year term shall
expire June 1, 1945, or when their successors are appointed, and the
terms of the three members of the Commission holding for a two year
term shall expire on June 1, 1946, or until their successors are
appointed, and the terms of the members appointed for a three year
term shall expire on June 1, 1947, or when their successors are
appointed. The absence of any member for three consecutive meetings t
the Commission, without a reasonable excuse, shall be deemed a
+ resignation from the Commission of such member, and the Mayor, at his
x discretion, shall fill said vacancy for the unexpired term for which
said member was appointed. At the expiration of the terms' of office
of the members, as set forth above, the Mayor shall appoint successors
for three year terms to fill the vacancies created by the expiration
of the term; said appointments to be confirmed by the City* Council.
F,:ve members shall constitute a quorum of said Commission.

SECTION 2. Ordinance No. 4960 of the Ordinance of the City of
Little Rock, Arkansas, is hereby amended to conform to the provisions
of Section 1 of this Ordinance.
SECTION 3. Because the immediate and efficient functioning of
the City Planning Commission is of great importance to the City of
Little Rock; and the citizens thereof; and because at the present time

_there is some confusion as to the powers and status of the City Plan-
ning Commission; and because this ordinance will resolve that confusion

1 with certainty; and because it is vital that the work of the City
Planning Commission continue without interruption, an emergency is
hereby declared to exist, and this ordinance being necessary for the
preservation of the public peace, health and safety, shall be in full
force and effect from and after its passage.
