ORDINANCE NO. 6671 AN ORDINANCE PROHIBITING THE OPERATION OF CARNIVALS OR FERRIS WHEELS, ROLLER COASTERS, MERRY -GO- ROUNDS, LOOP -O- PLANES, OR ANY OTHER AMUSE - MENT DEVICES USUALLY OPERATED IN CARNIVALS, UNLESS AND UNTIL A LICENSE HAS BEEN OBTAINED THEREFOR; DECLARING VIOLATIONS A MISDEMEANOR; DECLAR- ING AN EMERGENCY; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF LITTLE ROCK, ARKANSAS: SECTION 1. No carnival, Perris wheel, roller coaster, merry -go- round, loop -o- plane, or any other similar amusement device or exhibi- tion, other than theatres and motion picture shows exclusively opera- ted as such and separately licensed, shall be operated within this City unless and until a license therefor has been obtained. SECTION 2. Application for license for the operation of any of the carnivals, exhibitions or amusement devices described and referred to in Section 1 of this Ordinance shall particularly describe the amusement devices and shows desired to be licensed, and the exact place in the City at which they are to be operated; and such applica- tion for license shall be filed with the City Collector and by him referred to the Police Committee; and no license for the operation of any such amusement device shall be issued until approved by the Police Committee. SECTION 3. Any such license may be revoked at any time by the City Council when a majority of the Council deems that the operation of the amusements under such license are a nuisance in the neighbor- hood, or too difficult for the City reasonably to police; and on such revocation the unearned portion of the license fee shall be refunded to the licensee. SECTION 4. The license fee for the operation of the carnivals or exhibitions described and referred to in Section 1 of this Ordinance shall be as follows: $35.00 per day for those carnivals or exhibitions where the entrance fee to such carnival or exhibition is fifty cents (50�) or more per person. $25.00 per day for those carnivals or exhibitions where the entrance fee to such carnival or exhibition is less than fifty cents (50¢) per person. The license fee for the operation of amusement devices described and referred to in Section 1 of this Ordinance shall be $5.00 per dam. All license fees required under the provisions of this Ordinance shall be payable in advance. M i SECTION 5. The provisions of this Ordinance shall not apply to carnivals or amusement devices operated in the City Park or any other public parks in the City, SECTION 6. The operation of any of the amusement devices re- quired to be licensed hereunder, without first having obtained a license therefor, shall be a misdemeanor punishable by a fine Of fio One Hundred Dollars ($100.00), and each day's operation without a license shall be a separate offense. SECTION ?. Because of the large increase in the population of the City and the necessity for adequate police protection in various parts of the City, the manpower shortage, and the necessity of im- mediately preventing the gathering and remaining of crowds at any particular points in the City where it is difficult or impossible adequately to police them, particularly late at night, it is found that the immediate operation of this Ordinance is necessary for the preservation of the public peace, health and safety; and an emergency is hereby declared to exist, and this Ordinance shall be in full force and effect from and after its passage.
