AN ORDINANCE REGULATING THE CONDUCT OF CHAUFFEURS IN THE
CITY OF LITTLE ROCK, ARKANSAS, DECLARING A1T EITERGENCY AND
FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF LITTLE ROC,i, ARKANSAS:
SECTIOPT 1. The term "Chauffeur" as used herein shall mean
any and all persons who, for hire, operate any automobile, truck,
taxi cab, xiLxXXxxxX bus, tractor or animal drawn vehicle, for,
or on behalf of, the owner thereof.
The term "operate for hire ", as used herein, shall mean
the operation of any of the named z *ehicles or conveyances, for
or in behalf of the owner thereof in any manner, when such
operati:on results in a profit, directly or indirectly, to the
operator.
SECTION 2. It shall be unlawful for any chauffeur to
operate any vehicle or convetrance while he has in his possession,
or is under the influence to any degree. of, a,iy narcotic, drug,
opiate, whiskey, wine, beer or any other alcoholic beverage.
SECTI0I41 3. Any person who violates any of the terms of this
ordinance shall be deemed guilty of a misdemeanor and upon con-
viction te:ereof shall be fined not less than $25,.0.0 nor more than
$250.00 or shall be imprisoned in the City, Jail for a period not
exceeding six (6) months, or both fined and it prisoned, and the
Court who renders such conviction may revoke or suspend the
chauffeur's license of such person.
Upon conviction of any chauffeur for violation of any of the
terms of this ordinance, the clerk of the court rendering, such
judgment of conviction shall i?:.mediately certify such conviction
to the. City Collector ,,ho is hereby required to '.-B ep a register
of such. If any chauffeur shall be adjudged guilty of violating
any of the terms of this ordinance a second time, in addition to
any other penalty herein_ provided for, his chauffeur's license
shall be autocratically revoked for a period of one (1) year from
the date of such second conviction, and the same cannot be re-
issued.
SECTION 4. The Chief of Police, upon the request of the
City Collector, is hereby authorized and directed to revoke the
license of any chauffeur who may be found guilty of any mis-
demeanor or felony that involves moral terpitude or the physical
safety of persons and p.rope_ ty upon the streets of this City.
SECTION 59 The invalidity of any section or part of this
ordinance shall not affect any other section or portion hereof.
SECTION 6. Because there is at the present time inadequate
regulation of chauffeurs permitted to operate vehicles for hire
upon the streets of Little Pock, and because the lace of adequate
regulation exposes persons in this City to great peril, and
because the public peace, health and safety is thereby threatened
and this ordinance will correct that situation, an emergency is
hereby declared to exist and that this ordinance shall be in
full force and effect from and after its passage.
