AN ORDINANCE AMENDING ORDINANCE NO. 5420 OF THE ORDINANCES OF THE CITY OF LITTLE ROCK, AS AMENDED, BY PLACING CERTAIN TERRITORIES IN THE "B ZISIDENCE" DISTRICT UNDER SAID ORDINANCE, DECLARING AN EMERGENCY, AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF LITTLE ROCK, ARKANSAS: SECTION 1.. All the territory lying between the former limits 4!� th• -City of Little Rook, Arkansas (Prior to an- order of annex&- tion entered by the 2nd Division of the Pulaski County Circuit Court and affirmed February 5, 1945 by the Arkansas Supreme Court) and the following limits: 1. Beginning at a point on the former boundary of the City of Little Rook, such point being the intersection of the center line of Lee Avenue with the center line of Hayes Street, thence south along the center line of Hayes Street, for a distance of approximately 2640' to the inter- section of the center line of Hayes Street with the center line of West Capitol Avenue extended, such point being on the former boundary of the City of Little Rock. 2• Beginning at a point on the former boundary of the City of Little Rock, such point being the intersection of the center line of West 8th Street with the center line of Fair Park Boulevard, thence south along the center line of Fair Park Boulevard, to the center line of West 12th Street, thence west along the center line of West 18th Street to the center line of Taylor Street, thence south along the center line of Taylor Street to the center line of West 16th Street, thence west along the center line of West 16th Street to the center line of Buchanan Street, thence south along the center line of Buchanan Street to the center line of West 20th Street, thence east along the center line of West 20th Street to the center line of Filmore Street, thence south along the center line of Filmore Street to the center line of West 28th Streets thence east along the center line of West 28th Street to-the center line of Taylor Street, thence south along the center line of Taylor Street to a point on the north boundary line of Toska Leymer Addition, in the Northwest i of Section 18, Township 1 North, Range 12 West, such point being 201 east and approximately 15 feet south of the Southeast corner of. Lot 6, Block 16, C. 0. Brack Addition, in the Northwest -j of Section 18, Township 1 North, Range 12 Went; thence in a generally southeasterly direction to the obater line of Asher Avenue with its intersection with the center line of Taylor Street, thence in a generally southeasterly direotion along the center line of Taylor Street, to the center line of West 34th Street, in Ruebel and Leymer's Addition, in the Northeast 4, Southwest of Section 18, Township 1 North, Range 12 West; thence in a generally northeasterly direction along the.,eenter line of West 34th Street to the west line of the Southeast, Northeast I of Section 18, Township 1 North, Range 12 West; thence in a generally northeasterly direction to the South- west Corner of Lot 14, Block 7, Remmel Addition, such corner being on the north right -of -way line of the Missouri Pacific r Spur; thence along the south line of Blocks 7, 8, 9, 10 and 11 to the southeast corner of Block 11, all in Remmelfs Addition, thence north along the west right -of- way line of Elm Street to an intersection of the south - line of the Northwest 4, Northwest j of Section 17, Town- ship 1 North, Range 12 West- thence east along the south line to the North -1130 North 2 of Section 17, Township 1 North, Range 12 West, to the former boundary. of the City of Little Rock. r 3. Also beginning at a point on the former boundary of the City of Little Rook, such point being on the west line of the Northeast of Section 13, Township 1 North, Range 12 West, at the intersection of said west line with the center line of the East Roosevelt Road extended, thence east to the intersection of the center line of Roosevelt Road extension, with the east right -of -way line of Frasier Pike, thence east along the center line of East Roosevelt Road extension to the center line of Factoria Avenue, thence north along the center line of Factoria Avenue to the center line of East 17th Street, thence east along the center line of East 17th Street to the center line of Lawson Avenue, thence north along the center line of Lawson Avenue to the center line of East 10th Street, thence west along the center line of East 10th Street, to the center line of Union Street, thence north along the center line of Union Street to the right descending bank of the Arkansas River. is hereby placed in the "B Residence "' District under the terms and provisions of Ordinance No. 5420, of the Ordinances of the City of Little Rook as amended, and henceforth said lands shall be in the *B Reeidenoe," District. SECTION 2. Ordinance No. 5420 of the Ordinances of the City of Little Rock, as amended, is hereby amended to conform with the provisions of Section 1 of this Ordinance. SECTION 3. The lawful use of land existing at the time of the passage of this Ordinance on those lands described in Section 1 of this Ordinance, although such use does not conform to the provisions hereof, may continue, but if any such non - conforming use is discon- tinued, any future use of said lands shall be in conformity with the provisions of this Ordinance. The lawful use of a building existing at the time of the passage of this Ordinance, in the lands described in Section 1 of this Ordinance, may be continued, although such use does not conform with the provisions hereof, and such use may be extended throughout the building provided no structural alterations, except those required by law or ordinance, are made therein. If no structural alterations are made, a nonconforming use of the building may be changed to another nonconforming use of the same or more restricted olassifi- cation. If such nonconforming building is removed, every future use of said lands shall be in conformity with the provisions of this ordinance. The foregoing provisions shall be applicable to nonconforming uses in districts hereafter changed. Nothing in this Ordinance shall be deemed to prevent the re- storation of a building destroyed to the extent of not more than 75 per cent of its reasonable value, by fire, explosion or other casualty, or the public enemy, nor the continued occupancy or use of such building or part thereof which existed at the time of such partial destruction. ,,N1 SECTION 4. This Ordinance shall not in any I'interfere with or abrogate or annul any easements, covenants or agreement between parties affected by lands described in Section 1 of this Ordinance nor shall it interfere with the provisions in any Bills of Assurance now in effect. SECTION 5. Because the lands described in Section 1 of this Ordinance may be used for a variety of purposes that are at variance with and hostile to the zoning plans and regulations governing the rest of the City of Little Rook; and because thereby unrestricted " building is permitted that may constitute a fire hazard or a hazard to health and would also involve the risk of the City incurring un- necessary and wasteful expense; and because said lands should be zoned so as to prevent said condition; an emergency is hereby de- olared to exist, and this Ordinance is found to be vital to the public peace, health and safety and the same shall be in full force and effect from and after its passage.
