AN ORDINANCE GRANTING TO JOSEPH B. FLEMING AND AARON COLNON, TRUS-
TEES OF THE CHICAGO, ROCK ISLAND AND PACIFIC RAILWAY COMPANY,
THEIR SUCCESSORS AND ASSIGNS, A RIGHT OF WAY ACROSS MCLEAN STREET
AT ITS INTERSECTION WITH EAST FIFTH STREET AND ACROSS AND ALONG
EAST FIFTH STREET, IN THE CITY OF LITTLE ROCK, ARKANSAS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK:
Section 1. Joseph B. Fleming and Aaron Colnon, Trustees
of `The Chicago, Rock Island and Pacific Railway Company, their "suet-
cessors and assigns, are hereby authorized to construct, maintain
and operate a spur track across McLean Street at its intersection
with East Fifth Street and across and along East Fifth Street in the
City of Little Rock, said right of way to be 17 feet in width and
more particularly described as follows, to wit:
Begin in East Fifth Street from a point on the South
line of East Fifth Street approximately 15 feet Easter-
ly from the Easterly line of McLean Street, thence ex-
tending Westerly on a 14 degree and 56 minute curve to
the left to a point approximately 120 feet Westerly
from the Westerly line of McLean Street, said point
being 8.5 feet Southerly from the North line of said
East Fifth Street, thence continuing Westerly parallel
to and 8.5 feet Southerly from the said North line of
East Fifth Street to the Easterly line of Byrd Street,
in accordance with plat thereof on file in the Office
of the City Clerk,
Section 2. Said Trustees, their successors or assigns,-.
shall maintain said track so that the top of the rails shall be on
a level with the grade of the street as now or hereafter established,
and shall be built and maintained so as not to interfere with-any
water way or flow of same, and the City shall have the right to
ter said grade at its pleasure without responsibility to

tees, their successors or assigns. The Trustees, their successors or
assigns, shall also maintain between the rails of said track and two
(2) feet on each side thereof material as the street now is, or may
hereafter be, constructed at said point.
Section 3. The use of said track shall be so conducted as
not to interfere with the usual traffic along East Fifth Street.
Section 4. For this grant the said Trustees, their successors
or assigns, shall pay to the City of Little Rock the sum of $25.00 per
annum, payable annually in advance.
Section 5. This grant shall be and remain in force and ef-
fect for a period of twenty -five (25) years from and after the date of
the acceptance of this ordinance by the Trustees of The Chicago, Rock
Island and Pacific Railway Company, provided that same is accepted
