The following definitions shall apply is the rptaiiea sad the- enfersoment of this ordinances Its l lestaurent. --lhe term "restsnrsnt" shall mean restaurant, coffee shop, cafeteria, short order cafe, luncheonette, tavern, sandwich stand, soda fountain, and all other eating or drinking establishments, as well as kitchens or other places in which food or drink is prepared for sale.elsewhers. Item 2 Itinerant Eestawrant..•The-, term "itinerant restaurant" shall mean one operating for temporary period in oonnection.with a fair, carnival, circus, public eshibition,`or other similar gathering. Item 3 Imalor -The term "onployee" shall mean any person who handles 4 food or drink during preparation or serving, or who comes in contact with any eating or:coAkJLpg utensils, or who is eswloyed in a room in which food or drink It prepswed or served. Item 4 jtjA2Qs--- "Htensils" shall include any kitchenware, tableware, glassware, cutlery, utensils, containers, or other equipment with which food or drink comes in contact during storage, preparation, or serving. Item 5 lealth Officer. --The term "health Officer" shall mean the health officer of the City of Little Bock or his authorised representative. It shall be unlawful for any person to operate a restaurant in the city of Little look who does not posses sa unreveked permit from the health officer. Such permit shall be posted in a conspicuous place. At least once every six (6) months the health officer shall inspect every restaurant located within the city of Little Rook. The grading of Restaurants. The grading of all restaurants shall be based upon the following standards:: (A) all grade'AL* restaurants shall somply ed.th all of the following items of sank. tation. The floors of ail rooms in which food or drink is a tored, prepared, or served, or in shich utensils are washed, shall be of such ccmastruetion as to be easily cleaned, shall be smooth, and shall be kept clean and in good repair. Toilet rooms shall be kept is a clean condition, in good repair, and well lighted and Ton- tilated. Hardwa_shing signs shall ba posted in each toilet room used by wmployaes. In ease privies or earth cl os ets are permitted and used, they shall be separate from restaurant building, and shall be of a sanitary type constructed and operated in sonformity with the standards of the State Board of Health. Lavatory Facilities.. Adequate and convenient hand - washing facilities shall be provided, including hot and cold running water, soap, and approved sanitary towels. The use of a oommon towel is prohibited. No employee shall resumes work after using the toilet room without first washing his hands. ITEN 9. Construction of Utensils and ate= All mitimuse and all show display cases or windows, counters, shelves, tables, refrigerating equipment or utensils used in eonnestioa with the operation of a restaurant shall be so constructed as to be easily cleaned and shall be kept in good repair. *utensils containing or plated with osdnimt or lead shall not be used,- Provided, That solder containing lead may be used for jointing. ITSIt 10• CleaniM and Bactericidal Treatment of utensils and Egaipynt, All equipment, including display cases or windows, counters, shelves, tables, refrigerators, stovess hoods, and sinks, shall be kept Olean and free from dust, dirt, inseots, and other oontsmimting material. All cloths used by waiters, chars, and other "Vloyees shall be clean* Singls- service containers shall be used only ones. All 'kltiwse sating and drinking utensils shall be thoroughly cleaned and effect- ively subjected to an approved bactericidal process after each usage. All maulti -use utensils used in the preparation or serving of food and, drink shall be thoroughly cleaned and effectively subjected to an approved bactericidal process I sdedlately following the day's operation. Drying cloths, if used, shall be clean and shall be used for no other purpose. No article, polish, or other substance containing any cyanide preparation or other poisonous materiel shall be used for the cleaning or polishing of utensils, ITEM 11. Storage and Handling of Utensils and Equipment. After bactericidal treatment utensils shall be stored in a clean, dry place protected from flies, dust, and other eentamimationo and shall be handled in such a meaner as to prevent eon - tamination as far as practicable. Single- serviee utensils shall be pardbased only in sanitary containers, shall be aftred therein in a clean, dry place until used, and shall be handled in a sanitary manner- ITEM 12. Disposal of wastes. All wastes shall be properly disposed of, and all garbage and trash shall be kept in suitable receptacles, in each manner as not to become a nuisance. ITEM 13, Refrigeration. All readily perishable food and drink shall be kept at or below SOoF9 except when being prepared or served* waste water from refrigers- tion equipment shall be properly disposed of. ITEM 149 1holesomeness of Food and Drink. All food and drink shall be clean, wholesome, free from spoilage, and no prepared as to be safe for human sonaumptien. All milk, fluid milk products, ioe cream, and other frozen deserts served shall be from approved sources. Milk and fluid milk products shall be served in the indi- vidual original containers in which they were received from ibe distributor or from a balk container equipped with an approved disponsiag devioes Provided, That this requirement shall not apply to cream, which may be served from t he or iginal be ttl e or frond a dispenser approved for such serviee. All oysters, alone, and mussels shall be frond approved sources, and if shucked shall be kept until used in 1ho containers in which they were placed at the shucking plant. ITEfd 15. Storage, Display, and Serviaart of Food a" brink. Ali food and drink .� , .- shall be so stored, displayed, and served as to be protected from dust, flies, vermin, depredation and pollution by rodents, unnecessary handl irg, droplet infection, over- head leakage, and other contamination* No animals or fowls shall be kept or allowed in any rose in which food or drink is prepared or stored. All means necessary for the elimination of flies, roaches, and rodents shall be used. Amployees shall not expectorate or use tobacco in any fors in rooms in which food is prepared- ITIN 17. Niseellaneens. The premises of all rsstsurannts shall be kept Olean and free of litter or rubbish. None of the operations connected with a restaurant shall be conducted in any room used as living or sleeping quarters. Adequate lookers or dressing rooms shall be provided for employoost clothing and shall be kept clean. Soiled linens, coats, and aprons shall be kept in containers Provided for this purpose. (C) MUM *C* nSTAU8AWS. Grade "C" restaurants are those which fail to comply with either the gradeOPA" or the grade "V requirements. SECTION 8. 8einstateeant of Permit; Sugplementary Regrading, Any restaurant the grade of which has been lowered and all grade displays have been obanged accord- ingly, or the permit of which has been suspended may at any time make application for regrading or the reinstatement of the permit. Within one week after the receipt of a satisfactory application, accompanied by a statement signed by the applicant to the effect that the violated provision or pro- visions of this ordinance nave been conformed with, the health office* shall asks a reinspeetion, and thereafter as many additional, reinspections as he say deem noes- nary to assure himself that the applicant is again complying with 1he higher grade requiremente, and, in ease the findings indicate complian©o, shall award the higher grade or reinstate the permit. SECTION 9. Disease Control. No person who is affected with any disease in a eesmmanieable form or is a carrier of such disease shall work in any restaurant, and no restaurant shall employ any such person or any person suapected of being affected with any disease in a oonnanioable form or of being a carrier of such disease. If the restaurant namgw suspects that any employee has contrasted any disease in a eoasanisable fora or has beoeme a Barrier of sash disease he shell notify the health officer las6diately. A placard containing this section shall be posted in all toilet rooms. SECTION 10. Prodedure When Infection suspected. When suspicion arises as to the possibility of transmission of Infection from any restaurant employee the health, officer to authorised to require any or all the following measurnot- (1) . the isaedi- ate exclusion Of the employee !toms all restaurants; (2) the immediate *losing of the restaurant concerned until no further danger of disease outbreak exista, in the opinion of the health effieer= (3) adequate medical motions of the eucplope and of h nassoei&to$, with such laboratory examinations as may be indicated. SWTION 11. Enforcement Interpre�n. This ordinance shall be enforced by the health officer in accordance with the interpretations thereof contained , in the e 1943 edition of the Ue 3• Public Health Service Code Hegul& 6 , Bating and Drink- ing Establishments. SWTIM 12. Penalties. SBCTION 139 Repeal and Date of Effect• All ordinances and parts of ordinan- sus in conflict with this ordinance are hereby repealed, and this ordinance shall be in full foree and egfeci immediately upon its passage and approval. SWTIOW 14. Unconstitutionality Cl_ uuse.
