AN ORDINANCE GRANTING TO THE ARKANSAS LOUISIANA GAS
COMPANY, ITS SUCCESSORS AND ASSIGNS, AN EASEMENT AND
RIGHT OF WAY OVER AND THROUGH A PORTION OF THE LANDS
OF THE ISAAC T. GILLAM, SR.p MEMORIAL PARK FOR THE
PURPOSE OF LAYING, INSTALLING, MAINTAINING AND REMOV-
ING A GAS DISTRIBUTION PIPE LINE AND APPURTENANCES
INCIDENT THERETO.
WHEREAS, the City of Little Rock is the owner of the North
Half OW of the Northeast Quarter (NEJ) of Section Twenty -six (26) and the
Southeast Quarter (SE) of the Southeast Quarter (SE) of Section Twenty-
three (23) all in Township One (1) North, Range Twelve (12) west, Pulaski
County, Arkansas, both of which tracts of land comprise a portion of Isaac T.
Gillam, Sr., Memorial Park, and
WHEREAS, said Arkansas Louisiana Gas Company and its predecessor
Arkansas Louisiana Pipe Line Company, have heretofore been granted easements
across said lands for the laying of two 4 -inch pipe lines, which lines are now in
use, and
WHEREAS, Arkansas Louisiana Gas Company now finds it neeessary
to lay, and maintain a large gas distribution pipe line twelve inches (12 "), More
or less, in diameter, in addition to the two J+-inch distribution pipe lines afore-
said in order that an adequate supply of gas may be furnished to Greater Little
Rock for industrial and domestic uses, and has applied to the City of Little
Rock for the granting of an additional easement and right of way for the purpose
of laying, installing, maintaining and removing said larger pipe lines
NOWp THEREFORE, be it ordained by the City Council of the City

SECTION 1. There is hereby granted to Arkansas Louisiana Gas
Company, a Delaware corporation, its successors and assigns, an easement and right
of way thirty feet (301) in width over and through the lands hereinabove described
for the purpose of laying, installing, maintaining, operating, repairing and
removing a gas distribution pipe line twelve inches (12 "), more or less, in
diameter, together with all appurtenances incident thereto, and together with
the right of ingress and egress to and from said lands for such purposes.
SECTION 2. Said easement and right of way shall be for a period
Of fifty (50) years and so long thereafter as it is used for the purpose of dis-
tributing natural or artificial gas, and that portion of said easement and right of
way herein granted over the north half of the Northeast Quarter (N*(EJ) of Section
Twenty -six (26) aforesaid shall run parallel to, and the south line thereof a
distance of fifty feet (501) from, the most southerly of the two 4 -inch pipe lines
now installed thereon, and said easement and right of way herein granted over the
Southeast Quarter of the Southeast Quarter (SEJSEJ) of Section Twenty -three (23)
aforesaid shall be confined to and located in the south three hundred feet (3000
of the east one hundred feet (1001) of the Southeast Quarter of the Southeast
Quarter ) of Section Twenty -three (23) aforesaid; the location of said

plat.or blue print: survey heretofore filed by Arkansas Louisiana Gas Company with
the City Clerk of Little Rock.
SECTION 3. All mains and pipe lines laid over and across said
lands under the authority and provisions of this Ordinance shall be laid at a
depth of not less than eighteen inches (lg") beneath the surface of the ground,
and all excavations made in connection with installation, or repairs, or removal
of same shall be filled and tamped and maintained level with the adjoining surface.

In the event the City at any time should change or alter the present grade
or soil level of that part of said lands traversed by such pipe lines and
it should became necessary by reason thereof to lower the same to a. greater
depth, the cost thereof shall be borne by Arkansas Louisiana Gas Company,
its successors and assigns.
SECTION A. The City shall receive the sun of ONE HUNDMW
SIXTY-FIVE LLe -s ($165.00) as a consideration for the granting of this

Ordinance.
SECTION 5. Arkansas Louisiana Gas Cespany shall not erect or
maintain any buildings open any part of the easement and right of way herein
granted without the consent of the City of Little.Rook first obtained and -
evidenced by the passage of.an ordinance, expressly granting such privilege,
and, in the event of the passage of such an ordinance or ordinances hereafter
and the erection of any building or buildings in accordance therewith,
the plans for such buildings shall be approved by the City Engineer prior
to construction; and the Arkansas Louisiana Gas Company, its agents and
employees, after the installation of said pipe line, shall thereafter enter
upon said right of way only for the purpose of inspecting, repairing, main-
taining and removing said pipe line and the City of Little Rock shall have the
right is make any use of the property included in said easement and right of
way which does not hinder or obstruct the maintenance, operation, repair
and removal of said pipe line.
Ste. All ordinances and parts of ordinances in conflict
herewith are hereby repealed.
SECTION 7. WHEREAS, a new power plant is now under construction

to the Cities of Little Rock and North Little Rook and envire►ns, and c
industries are in course of construction or expansion in the Greater Little
Rock Area and a greater supply of gas is immediately necessary in order that
the future operations of these industries not be hampered,, it is found that an
emergency exists and for this reason it is hereby declared necessary for the
preservation of the public peace, health and safety that this Ordinance shall
take effect and be in force from and after its passage.
