AN ORDINANCE REPEALING ORDINANCE NO. 5759 OF T� ORDINANCES OF
THE CITY OF LITTLE ROCK, ARKANSAS; AMENDING ORD NANCE NO. 7159
OF THE ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS; INCREASING
CERTAIN PRIVILEGE AND OCCUPATION TAXES IN THE CITE OF LITTLE ROCK,
ARKANSAS; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES.
WHEREAS, The City Council of the City of Little Rock has
ascertained that additional revenues for the operation of the City
government are necessary; and
WHEREAS, because of the - existing State laws, the City
Council is limited in the type and amount of tax which it can
assess against the citizens of Little Rock in order to raise revenue
to carry on municipal functions; and
WHEREAS, the City Council desires that a budget for the year
1947 be adopted in order that the citizens of the City of Little
Rock may be informed in advance of'the proposed expenditures by
the City government; and
WHEREAS, an emergency exists at the present time because of
the increase in salaries of all City employees and the insufficiency
of present taxes to raise the necessary revenues for the payment of
salaries and City governmental functions during the calendar year
1947; and
WHEREAS, it is the intention and purpose of the City Council
generally to raise existing privilege and occupation taxes and
license fees fifty (50/) percent for the year 1947, over the amounts
collected by such taxes and fees in 1946;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF LITTLE ROCK, ARKANSAS.
Section 1, Ordinance No. 5759 is hereby repealed, and
Section One of Ordinance No, 7159 of the Ordinances of the City of
Little Rock, Arkansas, is hereby amended to read as follows;

"From and after the effective date of this
Ordinance, any person, firm, or corporation engaged
in the business, within the City of Little Rock,
Arkansas, of selling any or all kinds of goods, wares,
and /or merchandise, whether raw materials or finished
products, or both, from a regularly established place
of business maintained in the City of Little Rock,
shall pay an annual privilege tax for the privilege
of doing business within the City of Little Rock, in
accordance with the following graduated brackets:
WHERE STOCK AVERAGES:
1. From $1.00 to $50,000.00 - one and one -
half percent (1-21-%);
2. y$50,000.00, but not exceeding $100,000.00
one percent (1/);
3. $1009000.00, but not exceeding $200,000.00 -
one- fourth of one percent (1 /4th of 1 %);
4. $200000o.00 and over - one -tenth of one
percent (1 /10th of 1%) ."
Section 2. The privilege tax herein provided for shall be
due and payable on a semi - annual basis. The semi - annual install-
ments shall be due and payable not later than January I* and July
1, of each year.
Section 3. Said payments shall be made to the City Collector
of the City of Little Rock, and it shall be the duty of the City
Collector to prepare and furnish forms to all persons, firms, and
corporations who are liable for the license fee, prior to the day
upon which the license fee is due. Said persons, firms, and
corporations shall then return said forms, together with payment
for the proper amount of tax, to the City Collector. After
determining that the amount of the license fee tendered is correct,
the City Collector shall issue a license and return it to the person,
firm, or corporation paying the tax. The license herein provided

for shall not be transferrable.
Section 4. The City Collector or his duly authorized
Deputy shall have the right to check and audit the stocks of any
persons, firms, and /or corporations subject to this license fee
at any reasonable time.
Section 5. The City Collector shall affix penalties for
the failure to pay the license fee herein due as follows:
1. Five per cent (5%) of the amount due when
the payment is made within thirty (30) days
past the due date of the license fee.
2. Ten per cent (10%) of the amount due when
the payment is made within sixty (60) days
past the due date of the license fee.
31 Fifteen per cent (15,%) of the amount due
when the payment is made within ninety (90)
days past the due date of the license fee.
Section 6. Any person, firm, or corporation doing business
in the City of Little Rock without the payment of the license fee
hereinabove provided and without having been issued a license to
transact its business shall be deemed guilty of a misdemeanor and
upon conviction in the Little Rock Municipal Court shall be subject
to a fine of not less than Five Dollars ($'5.00) nor more than Five
Hundred Dollars ($500.00), and each day that such person, firm, or
corporation operates in violation hereof shall constitute a separate
offense.
Section 7, All Ordinances or parts of Ordinances in conflict
herewith are hereby repealed.
Section S. This Ordinance shall be in full force and effect
in accordance with its terms, for the year 1947, as, of, and after
January 1, 1947.
Section 9. WHEREAS, it is necessary for the City of Little
Rock to obtain more revenue from privilege taxes in order to carry
on necessary governmental functions, and such increase should be

effective immediately in order to promote a fair schedule of pay-
ments by all persons affected by the Ordinance, THEREFORE, an
emergency is hereby declared to exist, and this Ordinance is
found to be necessary for the immediate preservation of the
public peace, health, and safety, and the same shall be in full
force and effect from and after its passage and approval, and
publication as provided by law.
