PORBECK THE RIGHT TO 11AINTAIN A SINGLE SPUR TRACK OR SWITCH FROM THE THIRD STREET SWITCH OF THE CHICAGO ROCK ISLAND & PACIFIC RAILWA -r, NORTH ACROSS EAST SECO10 STREET, TO THE PROPERTY OF SAID GRANTEE AS SAME REPIIAINS SITUATE IN BLOCK 7 POPE'S ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS. BE IT ORDAINED BY THE CITY COUNCIL OF T CITY OF LITTLE ROCK, ARKANSAS: SECTION I. That in consideration of the payment by Frank A, Porbeck and Clara H. Porbeck of the sum of Twenty five 025.00) Dollars per annum, payable annually in advance to the City of Little Rcok; the said Frank A, Porbeck and Clara H. Porbeck their executors, administrators or assigns are hereby permitted to maintain for a period of Twenty (20) years from and after the passage of this ordirmnee, a single spur track or switch leading from the Third Street switch of the Chicago Rock Island & Pacific:ailway Comrany where such Companies switch crosses diagonally Block 10 of Pone's Addition; said single spur track or switch to extend from said point in a northerly direction across east Second Street, crossing said street at direct right angles and continuing to the property of the grantee herein as the same now remains situate in Block 7 Popes Addition to the Oity of Little Rock, Arkansas. The grant herein being made upon the further express conditions that no cars shall be permitted to stand upon the said street or sidewalks as intersected by said switch, and that said switch shall in no way interfere with traffic on said street, and that the said grantee Frank A. Porbeck and Clara H. Porbeck, their executors, administrators or assigns shall build and maintain during the period of this grant, a pavement of like character and material between the rails of said switch and two feet on the outside of the rail thereof, as is now laid or of such a character airy material as such street may hereafter be raved, Said switch shall be so constructed and maintained so that the top of the rails shall be on a level with the grade of the street as is now or may hereafter be established by the City and said City stall have the right to alter or change said grade at its nleasure and without resronsibility to said grantees; said grantees shall construct said switch in such a manner as not to obstruct the drainage or flow of surface water in the gutters of said street and shall at all times keer such gutters open and free from all obstructions and the said Grantees shall hold the City harmless from damages of any kind occassioned by the said switch or the use of same, SECTIOiu 2. That this ordinance shall be in full force and effect from and after its pa ssage if accepted within twenty (20) days thereafter by the said grantees, such acceptance to be endorsed unon the margin of the record of such ordinance; and all ordinances and harts of ordinances in conflict with thb provisions of this ordinance be and the same are heresy renXealed.
