ORDINANCE NO. 19,216
3 AN ORDINANCE TO VACATE AND ABANDON THE EAST 145
4 FEET OF THE 40TH STREET RIGHT -OF -WAY BETWEEN FOSTER
5 AND WELDON STREETS, IN THE CITY OF LITTLE ROCK,
6 ARKANSAS; AND FOR OTHER PURPOSES.

8 WHEREAS, a request was made to abandon the East 145 feet of the 40th Street
9 public right -of -way between Foster and Weldon Streets, pursuant to the City's general
10 police power authority under Ark. Code Ann. § 14-54 -104;
11 WHEREAS, the Board has determined that the abandoning of this portion of the
12 public right -of -way will not have an adverse impact on the adjacent property owners
13 nor the local traffic, and therefore, the right -of -way abandoned by this ordinance is no
14 longer needed for corporate purposes except as otherwise noted below.
15 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
16 OF THE CITY OF LITTLE ROCK, ARKANSAS:
17 Section 1. The Board of Directors hereby releases, vacates, and abandons the
18 portion of the said right of way, together with the right of public in general, in the City
19 of Little Rock, Pulaski County, Arkansas.
20 Section 2. The City specifically reserves the public utility easements within the
21 former right -of -way.
22 Section 3. A copy of this ordinance duly certified by the City Clerk, shall be filed
23 in the real estate records of the recorder of the Circuit Clerk in ex officio recorder of
24 Pulaski County, Arkansas.
25 Section 4. Severability. In the event any title, section, paragraph, item,
26 sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid

or unconstitutional, such declaration or adjudication shall not affect the remaining
portions of the ordinance which shall remain in full force and effect as if the portion so
declared or adjudged to be invalid or unconstitutional was not originally a part of the
ordinance.
Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same
that are inconsistent with the provisions of this ordinance are hereby repealed to the
extent of such inconsistency.
