HomeMy WebLinkAbout19214I ORDINANCE NO. 19,214 2 3 4 AN ORDINANCE TO AMEND LITTLE ROCK, ARK., REV. 5 CODE §§ 32 -301 and 32 -309 (1988) TO COMBINE SAID 6 SECTIONS ON PENALTIES FOR METERED AND UNMETERED 7 PARKING; TO AMEND 32 -309 TO ADD PROVISIONS WHICH 8 MATCH THE STATE LAW PROVISIONS FOR UNMETERED 9 VIOLATIONS; AND FOR OTHER PURPOSES. 10 11 WHEREAS, the City has established by ordinance the fines to be assessed for 12 motor vehicles illegally parked in metered and unmetered restricted parking spaces, 13 and 14 WHEREAS, prior ordinance amendments in Little Rock, Ark. Ord. 18,611 is (December 18, 2001) and 18,644 (February 5, 2002) have resulted in the same penalties in 16 section 32 -301 and 32 -309 of the Little Rock, Ark. Rev. Code (1988) for metered and 17 unmetered restricted parking, and 18 WHEREAS, the City's list of unmetered restricted parking violations should 19 match that contained in the Arkansas statutes. 20 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS 21 OF THE CITY OF LITTLE ROCK, ARKANSAS: 22 Section 1. Little Rock, Ark., Rev. Code q 32 -301 (1988) is hereby amended to 23 read as follows: 24 The penalty for violation of overtime parking in all metered and 25 unmetered restricted parking areas shall be: 26 (a) Ten dollars ($10.00) if paid within twenty -one (21) days of the 27 issuance of the ticket; [PAGE 1 OF 41 Ordinance Parking fees 1 (b) Fifty dollars ($50.00) if paid after twenty -one (21) days of the 2 issuance of the ticket, or after conviction in district court for 3 violation of City parking ordinances. 4 A combination ticket and envelope shall be provided as the issuance of a 5 violation citation for the convenience of motorists. The penalty shall be paid 6 by placing such sum in the penalty box attached to the parking meters, or by 7 paying the fine to the City. 8 Section 2. Little Rock, Ark., Rev. Code § 32 -309 (1988) is hereby amended to 9 read as follows: 10 (a) No person shall stop, stand, or park a vehicle, except when necessary to 11 avoid conflict with other traffic or in compliance with the directions of a 12 police officer or traffic- control device, in any of the following places: 13 (1) On a sidewalk. 14 (2) In front of a public or private driveway.. 15 (3) Within an intersection. 16 (4) Within fifteen feet (15') of a fire hydrant. 17 (5) On a crosswalk. 18 (b) Within twenty feet (20') of a crosswalk at an intersection. 19 (7) Within thirty feet (30') upon the approach to any flashing 20 beacon, stop sign, or traffic - control signal located at the side 21 of a roadway. 22 (8) Between a safety zone and the adjacent curb or within thirty 23 feet (30') of points on the curb immediately opposite the ends 24 of a safety zone, unless the local traffic authority indicates a 25 different length by signs or markings. 26 (9) Within fifty feet (50') of the nearest rail of a railroad crossing. [PAGE 2 OF 41 Ordinance Parking fees 1 (10) Within twenty feet (20') of the driveway entrance to any fire 2 station and on the side of a street opposite the entrance to any 3 fire station within seventy -five (75') of the entrance when 4 properly signposted. 5 (11) Alongside or opposite any street excavation or obstruction 6 when stopping, standing, or parking would obstruct traffic. 7 (12) On a roadway side of any vehicle stopped or parked at the 8 edge of a curb or street. 9 (13) Upon any bridge or other elevated structure upon a highway 10 or within a highway tunnel. 11 (14) At any place where official signs prohibit stopping. 12 (b) No person shall move a vehicle not owned by the person into any 13 such prohibited area or away from a curb a distance that is unlawful. 14 is Section 3. Severability. In the event any title, section, paragraph, item, 16 sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid 17 or unconstitutional, such declaration or adjudication shall not affect the remaining 18 portions of the ordinance which shall remain in full force and effect as if the portion so 19 declared or adjudged invalid or unconstitutional was not originally a part of the 20 ordinance. 21 Section 4. Repealer. All resolutions, bylaws, and other matters inconsistent 22 with this resolution are hereby repealed to the extent of such inconsistency. 23 Section 7. Emergency.
