AN ORDINANCE GRANTING TO FRANKLIN E. LOY THE RIGHT TO
CONSTRUCT AND MAINTAIN A SPUR TRACK FROM THE CHICAGO,
ROCK.ISLAND & PACIFIC RAILWAY TRACKS DIRECTLY ACROSS
RAILROAD AVENUE IN A NORTHWESTERLY DIRECTION TO LOTS
11 AND 12, BLOCK 2, TWIN -CEN ADDITION TO THE CITY OF
LITTLE ROCK,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK,
ARKANSAS:
SECTION 1. In consideration of the payment of ten dollars
per annum, payable annually in advance, by Franklin E. Loy, his
successors or assigns, the said Franklin E. Loy, his successors
and assigns, is hereby permitted to build and maintain for a
period of twenty -five years a single spur track from the Chicago,
Rock Island & Pacific Railway tracks, near Arch Street, direct-
ly across Railroad Avenue, in a northwesterly direction to lots
eleven and twelve, block two, Twen -Cen Addition, City of Little
Rock, Arkansas.
SECTION 2. No cars shall be permitted to stand upon the
street or sidewalks intersected by said switch; said Franklin
E. Loy, his successors or assigns, shall build and maintain be-
tween the rails of said switch or spur, and two feet on each
outside thereof, should said street be paved, a pavement of like
character and material as that used in the pavement of said
street; said switch or spur shall be built and maintained so
that the top of the rails shall be on a level with the grade of
the street as now or hereafter established, and so as not to
interfere with any waterway or flow of same, and the city shall
have the right to alter said grade at its pleasure and without
responsibility to said grantee; and said grantee, his successors
or assigns, shall hold the city harmless from damages of any
kind occasioned by said switch, or by the use of same.
SECTION 3. Said grantee,shall within twenty days after the
passage of this ordinance signify his acceptance of the terms
and provisions thereof by writing his acceptance on the margin
of the record book wherein this ordinance is recorded. All
rights hereunder shall cease and determine on and after twenty-

five years from the date of the passage hereof; and at that
time said grantee, his successors or assigns shall remove said
switch at his or their own expense.
SECTION 4. All ordinances or parts of ordinances in con-
flirt herewith are hereby repealed and this ordinance shall be
in full force and effect from and after its passage and approval.
