HomeMy WebLinkAbout8003i - ..3' ORDINANCE NO. 8003 AN ORDINANCE VACATING AND ABANDONING THAT PORTION OF THE ALLEY IN BLOCK FORTY- TWO(42) BRAGdS SECOND ADDITION TO THE CITY OF LITTLE ROCK, RUNNING IN A NORTH -SOUTH DIRECTION, BEGINNING AT THE NORTH LINE OF ROOSEVELT ROAD AND ENDING AT THE SOUTH LINE OF EAST TWENTY -FIFTH STREET, CITY OF LITTLE ROCK, ARKANSAS. WHEREAS, a petition was duly filed with the City Council of the City of Little Rock on the 16th day of May, 1949, asking the City Council to vacate and abandon all that portion of the alley designated on the Plat of Bragg's Second Addition to the City of Little Rock, now appearing of record in Plat Book 2 at page 44, in the office of the Clerk and Ex- Officio Recorder of Pulaski County, Arkansas, said alley situate in Block Forty -two (42), Braggs Second Addition to the City of Little Rock, Arkansas, and begins at the North Line of Roosevelt Road and extends to the South Line of East 25th Street in the City of Little Rock, Arkansas, and more fully described as: Beginning at the intersection of the Quapaw Line and the North Line of East Roosevelt Road, and running thence in an Easterly Direction 192 feet to the point of beginning; thence in a Northerly direction 174.4 feet more or less to the South line of East Twenty -fifth Street; thence in an Easterly direction 10 feet, more or less; thence in a Southerly direction 174.4 feet, more or less,to the North line of East Roosevelt Road; thence in a Westerly direction 10 feet more or less to the point of beginning. WHEREAS, after due notices as required by law, the Council has at the time and place mentioned in the notices, heard all persons desiring to be heard on the question, and has ascertained that the alley hereinbefore described has heretofore been dedicated to the public use as an alley as herein described, and has not actually been used by the public generally for a period of at least five (5) years subsequent to the filing of the plat; that all of the owners of the property abutting upon the portion of the alley to be vacated, have filed with the Council their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such alley. L - t`0. 7Z NOW,THEREFORE, be it ordained by the City Council of the City of Little Rock, Arkansas: SECTION 1. The City of Little Rock, Arkansas,hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the said alley designated as follows: The alley extending in a North -South direction in Block Forty -two (42), Braggs Second Addition to the City of Little Rock, Arkansas, beginning at the intersection of the Quapaw line and the North Line of East Roosevelt Road, and running thence in an Easterly Direction 192 feet to the point of beginning; thence in a Northerly direction 174.4 feet more or less to the South line of East Twenty -fifth Street; thence in an Easterly direction 10 feet,more or less; thence in a Southerly direction 174.4 feet, more or less, to the North line of East Roosevelt Road; thence in a Westerly direction 10 feet more or less to the point of beginning. SECTION 2. A copy of the ordinance duly certified by the City Clerk shall be filed in the office of the Clerk and Ex -of- ficio Recorder of Pulaski County and recorded in the deed records of said County.
