HomeMy WebLinkAbout8096ORDINANCE N0. 8096 AN ORDINANCE CLOSING THAT PART OF THE ALLEY IN BLOCK 15, PULASKI HEIGHTS ADDITION, BETWEEN LOTS 3 AND 4 OF SAID BLOCK IN SAID ADDITION. WHEREAS, A petition was duly filed with the City Council of the City of Little Rock, Arkansas on the 17th day of August, 1949 asking the City Council to vacate and abandon all of that portion of the alley designated on the plat of Pulaski Heights Addition to the City of Little Rock now appearing of record in Plat Book No. 2, Page 58 in the office of the Recorder of Pulaski County, beginn- ing at Walnut Street and running West 150 feet, between Lots 3 and 4 of said Block 15 of Pulaski Heights Addition to the City of Little Rock, and WHEREAS, After due notice As required by law, the Council has at the time and place mentioned in such notice heard all the persons desir- ing to be heard upon the question and has ascertained that that portion of the alley hereinab©ve described has been dedicated to the public use as an alley and has not actually been used by the public generally for at least five (5) years subsequent to the filing of the plat; that all of the owners of the property abutt- ing on the portion of the alley to be vacated have filed with the Council their written consent to such abandonment; and that the public interest and welfare will not be adversely affected by the abandonment of such portion of said alley, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City Council of the City of Little Rock, Arkansas hereby releases, vacates, and abandons all of its rights, together with the fights of the public generally, in and to the alley designated as follows: That portion of the alley in Block 15 extending from Wal- nut Street 150 feet West, said alley being between Lots 3 and 4 of said Block, according to the re -plat of Pulaski Heights Addition as recorded in Plat Book No, 2 at Page 58 in the _2 office of the Recorder of Pulaski County, Arkansas. SECTION 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County and recorded in the deed records of said County. SECTION 3. All ordinances and parts of ordinances in con- flict herewith are hereby repealed, and this ordinance shall be in full orce and effect from and after its passage and approval.
