AN ORDINANCE DECLARING THE SALE AT RETAIL FROM A TRUCK,
WAGON, CART OR OTHER SUCH VEHICLE OR CONVEYANCE, OF FRUIT,
VEGETABLES, FISH, EGGS, POULTRY, PRODUCE AND /OR OTHER PRO-
VISIONS WITHIN THE CITY OF LITTLE ROCK WHERE ANY OR ALL OF
SUCH ARTICLES OR PROVISIONS HAVE BEEN BOUGHT FOR RESALE TO
BE A PRIVILEGE; FIXING A LICENSE THEREFOR, AND FOR OTHEit
PURPOSES
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK,
ARKANSAS:
SECTION 1. That the sale or offering for sale at retail from
a truck, wagon, cart or other such vehicle or conveyance of fresh
fruit, vegetables, fish, eggas, poultry, produce and /or other pro-
visions, which have been bought for the purpose of resale, is a priv-
ilege and when exercised within the city limits of the City of
Little Rock, Arkansas, any person, firm or corporation so exercising
such privilege shall secure a license therefor.
SECTION 2. Before exercising such privilege any person, firm,
or corporation shall make application to the City Collector and with
such application shall furnish the said City Collector the following
information: (1) Name, (2).Address, (3) Kind of conveyance to be used
in said business with the state license number and the make and tonn-
age of said truck or car or conveyance.
SECTION 3. The license herein provided for shall be for the
calendar year beginning January 1st, and expiring December 31st and
for such license the City Collector shall receive, and any person,
firm, or corporation desiring to engage in such business shall pay
a license fee as follows: (1) Truck and /or automobile, whether truck
or pleasure car, the sum of Fifteen Dollars ($15.00) per year. (2)
Push cart the sum of Five Dollars ($5.00)'per year. (3) And the
sale of such articles in baskets and /or buckets, the sum of Two
Dollars and Fifty Cents ($2.50) per year. Provided, however, that if
any such person shall sell or offer for sale provisions other than
fresh fruit, vegetables, fish, eggs, poultry, or other farm produce
from a vehicle or conveyance, such person, firm, or corporation shall
pay a license fee for the year as follows: For each truck or convey-
ance the sum of One 'Hundred and Fifty Dollars ($150.00).
SECTION 4. The City Collector shall have the power at his dis-
cretion to issue such licenses on a semi - annual basis.

SECTION 5. Any person, firm, or corporation making any sale or
sales of produce, poultry, eggs, fresh fruits, vegetables, fish, and /or
other provisions without first securing from the City Collector a
proper license therefor as herein provided shall be deemed guilty of
a misdemeanor and upon conviction of the first offense shall be sub-
ject to a fine of Five Dollars ($5.00); upon conviction of a second
offense shall be fined in the sum of $10.00; upon conviction of a
third offense the fine shall be in the sum of $25.00.
SECTION 6. The license herein provided for shall be displayed
at all times on the vehicle being used. Any person, firm, or corpor-
ation engaging in the sale of any of the provisions herein described
and failing and refusing to display the license tag herein issued,
shall be deemed guilty of a misdemeanor and upon conviction shall be
fined in the sum of Two Dollars ($2.00) for each such offense.
SECTION 7. Ordinance No. 5246 is hereby repealed, together with
all ordinances or parts of ordinances in conflict herewith, and as the
proper licensing of persons engaged in the sale of produce herein des-
cribed is necessary for the preservation of the public peace, health
and safety, an emergency is hereby declared to exist and this ordin-
ance is found to be necessary for the immediate preservation of the
public peace, health, and safety and the same shall be in full force
and effect from and after its passage and approval.
