HomeMy WebLinkAbout8284c f ORDINANCE NO. 8284 AN ORDINANCE TO RESTRICT THE NUMBER OF TAXICABS OPERATED IN THE CITY OF LITTLE ROCK, PROVIDING FOR THE APPLICATION TO INCREASE THE NU; "BER OF TAXICABS OPERATI'G AND THE GRANT - ING THEREOF UPON SI:OVIING OF "PUBLIC CONVENIENCE AND NECESS- ITY, AND FOR OTHER PURPOSES. WHEREAS, the streets of the City of Little Rock are over- crowded with vehicular traffic, and WHEREAS, it is imperative that every reasonable action be taken to control the increase in traffic on the streets and high- ways of the City; and WhEREAS, the Council finds that at the present time the taxi- cab companies licensed and operating in the City of Little Rock appear to offer sufficient facilities to serve the needs of the public; and WHEREAS, the Council finds it necessary to restrict the oper- ation of the taxicab companies to the number of taxicabs presently in operation; NOW THEREF ORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARK- ANSAS: SECTION 1. Each person, firm, or corporation heretofore licensed. ,4o operate and now operating taxicabs in the City of Little Ro-cli., Arkansas shall be restricted to the nurber of taxicabs for which such person, firm, or corporation secured licenses from the Revenue T7epartment of the State of Arkansas, or permits from the City Collector, whichever is smaller, as of the effective date of this ordinance, except as hereinafter provided. SECTION 2. In the event public convenience and necessity re- quire the use of a greater number of taxicabs, any person, firm, or corporation heretofore licensed to operate and now operating taxicabs in the City of Little Rock, Arkansas, may file with the M ty Collector an application for an increase in the number of taxi- cabs operated by such person, firm, or corporation, which applica- tion shall set forth: (1) That applicant is in compliance with the Statutes of the State of Arkansas; the ordinances of the City of Little Rock, and the regulations of the Taxicab Commission covering the operation of taxicabs. (2) The number of taxicabs operated by applicant. (3) The number of additional taxicabs requ6sted by applicant. (4) The facts which constitute public convenience and necess- ity for the additional service. SECTION 3. Upon the filing of such application, a public hear- ing on the application shall be conducted by the City Council, or -2- any committee designated by the Council. All persons interested in or affected by such application may appear either in person or by representatives at such hearing and introduce evidence and be heard either in support of or in opposition to such application. SECTION 4. After such hearing, the City Council shall find whether public convenience and necessity require additional service of the class and character described in such application, and, if the City Council finds that the public convenience and necessity require additional service, it shall by appropriate ordinance or resolution, authorize applicant to put into operation additional taxicabs in any number not to exceed the number requested in the application; provided, however, that the City Council and the City Collector shall not issue pernits for additional taxicabs until after ten days after the effective date of such ordinance or resol- ution to provide for judicial review of the finding of the City Council as to convenience and necessity for the additional service. SECTION 5. Any company which operated more taxicabs during the year 1949, ton are now being operated is hereby given sixty days from the date this ordinance is passed in which to secure additional licenses to bring the total to the nunher of taxicabs operated in 1949. SECTIOY 6. All persons, firms., or corporations shall within sixty days after the passage of this ordinance file with the City collector a complete inventory of all vehicles operated as taxi- cabs. Said inventory shall list the following: Make of vehicle, year, model, motor number, and state license number. SECTION 7. Nothing herein shall affect the payment of licen- ses or fees payable by any person, firm, or corporation licensed to operate taxicabs in the City of Little Rock. AECTION 8. Nothing herein is intended to amend Ordinance No. 6972 of the ordinances of the City of Little Rock. SECTION 9. Because the streets of the City of Little Rock are overcrowded at peak hours of the day with vehicular traffic, and because vehicular traffic requires imxaediate regulation to provide the greatest possible use of the streets to the inhabitants of the City of Little Rock, and because such traffic has congested the -3- highways and streets of the City of Little Rock and created a peril to the inhabitants and property of the City of Little Rock, and because this ordinance will give needed regulation, an emer- gency is hereby declared to exist, and this ordinance is found to be necessary for the public peace, health, and safety, and the same shall be in full force and effect from and after its passage and approval.
